no, i did not "misread" Rainman's post. i do know he said it WAS NOT in the DOT regualations. i said, its usually a company violation, and he could face charges from his company, or local/state/federal charges if he is caught with a firearm. he goes/went on to say that a person can carry a firearm in another state, if that other state reconizes the home state's (where the driver is from) gun laws. i simply said that would take some research as each state is different, and the laws change daily (or so it would seem, as NYC, in of itself has laws different from the rest of the other NY cities/towns). the best advice to have been given by Rainman would have been to say "don't carry any firearms".

my reasoning here now (and then) would be that some people would "read into" Rainman's statement, and start carrying firearms without full knowledge of the laws in EACH state a driver transverses each day/week/month.

the very BEST advice anyone can follow is, "DO NOT CARRY FIREARMS". the cost of arrest, lawyers, loss of job, and so on and so forth won't be worth the aggravation one faces while carrying a firearm.

 

I can make it simple fer ya... You have a Class “A” FEDERAL license. If you are caught with a gun in ANY state licensed or NOT it is a FELONY for a truck driver to carry one. YOU will go to J A I L Period. Ask someone in NY what might happen to a truck driver if they had a gun… Try going to the store (or truck stop) and buy a 6 pack of beer on your way home in your big truck and see what happens if you get stopped… Do not pass go… Go straight to jail… Same result EVERY time…

Truck drivers are 10' tall and bullet proof. Why carry a gun except to keep that cowboy image alive? Why, if faced with an immediate threat we could just whine the perpetrator to death. :smt028

You fine folks worry way to much about this subject. If you try to tote a hog-leg, or a hand cannon, you're gonna' get caught, and have troubles. Discretion is required.

I had a cousin (since passed) who somehow procured a street-sweeper (full auto, 12 gauge, machine gun) that he carried for years delivering meat from the mid-west to NYC. He kept it handy in the cab too. I guess he never got tangled up with the wrong LEO. Never lost a load of meat either. :smt070

 

I've known guys who've carried firearms with them in their rigs for years with no problems, and I personally don't have a problem with it. If a man is responsible enough to carry thousands of pounds of hazmat(capable of killing hundreds of people) through major metropolitin cities, surely he's responsible enough to carry a gun to protect himself. But to answer your question, It is illegal for any big truck(company or o/o) to be in possesion of a firearm and if caught you will be looking at a felony possession charge with a maximum of 10yrs fed time. If you do choose to carry, just be smart.

 

I'd rather be tried by 12 than carried by 6. Especially when I'm out doing what it takes to put food on the table, keep the lights on, or whatever.
Listen, business is business, and all the rest can run a marathon! No, I'm not looking for trouble, but if it comes, then I'll be prepared. People seem to forget that this country was founded by the gun. My family depends on me to be safe, and that equates to being ruthlessly prudent.

 

I called the DOT and NRA and specifically asked if there is a federal law making it illegal to carry a firearm in a CMV. There is no such law.
If the company employing you has a rule against it then obviously you could get fired if you do so anyway.
The DOT told me though if you do carry a firearm, you must abide by the state/local laws. However, if you are driving through a state that has a law against firearms in the vehicle you are exempt if the state you start driving in and the state you stop in both allow firearms in vehicles.
This does not mean you are allowed to have the firearm on your person if you are not licensed to carry. If you are unlicensed you can still have it in your truck, just not on your person when you get out of the truck.
I hope this helped clear up the fact and fiction floating around about guns in big trucks.

 

i think in this day and age it would be in our best intrests to carry a firearm in the truck.better safe than sorry.

 

You are way wrong on this. Show me EXACTLY where in the law it states that you cannot cross a state line with a handgun. That is absurd. Then after stating that you absolutely CANNOT, you turn around and say "usually." Your post is full of assumptions - "You will never be...," "You would need..." Looks like you are the one giving out the bad advice here.

The best site for information on carrying with a permit is www.packing.org. I would suggest you start by looking there and not listening to people that don;t know what they are talking about on this forum.
