Can I go off Duty on my Log Book?

    This is not agricultural. My shift changes from day to day. The day after the 15 hour day I might only work 8 hours and only start at 7am. We work just 5 days a week. No weekends. I hope all this is making sense. Even though I am local, I have a sleeper but never sleep in it. Would I be able to claim sleeper time for those off hours? I am trying to keep this legal if possible. I am still confused on this. Thanks again.

    Even with a sleeper...in order to use the "split sleeper" rule, the first section in the sleeper requires 8 hours in the sleeper, then continue extending the 14 hour requirement, but you can only use the balance left to accomplish the 11 hours driving, and not exceed it.

    If the 15 hour day was on your "friday" (last shift before a 34 hr off) then you could use that exception...but you don't show this in your scenario...you really need to check with Safety in your company to get the particulars on how they "say it can be done legally". You might want to get it in writing, on company letterhead...this way YOU won't be the only getting dumped on, but the company has admitted complicity to the act! And you are still responsible for participating in an illegal act!

    I still don't know how to help you out. Other half mentioned the one time thing per week, but I'd never heard of that either. Maybe that would work for you?:biggrin_25524:

    It will vary from state to state. If you are operating within a specific distance from your terminal, say 100 miles you would come under state regs in many locals. Need to find out what applies in your area.

    I thought that running local , less than 100 air miles radius you don't need a log book I'm thinking that you go less than 100 miles because it takes you 2 hours time including loading in the AM AND 2 HOURS INCLUDING UNLOADING IN THE PM but if you do need a log book your still not legal because if you don't get done till 8 at night and have to leave in the morning at 5 that means you only got 8 3/4 hours off duty at the end of your day (15 min. pre trip) You need a 10 hour break to start the next day. Just my thought I'm not sure about the log for local.
