Driver got pulled over in Michigan for Speeding

I have never seen the governing speed of a truck used as a winning defense,

however, that is only the cases I've seen !!!!!!

 

My late husband got pulled over in Ohio, after the Cambridge Scale. The cop said he clocked him at 70, sitting in the middle right before the scale. He was already slowing down to go in there. He was in a Hogan truck, and was governed at 62, or maybe 65. He said the traffic was heavy, both trucks and cars, and while I don't deny he had a lead foot, that time he was sure he was going at the speed limit or less because of the scale.

He went to court and gave him 64 in a 55, he had a letter that stated what he was governed at. So he got it lowered, but not dismissed.

 

I have also seen that, but I don't count that as a win, if ya know what I mean !!!

What a rip off though !!!!!!!!!!!!

All ontario canada trucks by law are governed at 65. I drive there ALL THE TIME.

 

You'd think that if you were to take it to court with proof the truck is governed to 62, a "thinking" judge would throw it out. Not saying it doesn't happen the other way around, but when I hear that it sorta makes me wonder.
Is there any chance the troop may have tagged someone else and mistakenly stopped your driver? Not defending either side.
I take it this is a Ca. truck? Or did I wrongly assume that?

 

Looking at that log book, your driver was over his 14. If he logged a pretrip for 15 minutes, his 14 started at 1130. He was stopped at 0148...18 minutes over his 14. If he was trying to split the sleeper, it was done improperly. The short break must be at least 2 hours, which his was, but it counts against the 14 hours. The other part of a split must have 8 continuous sleeper hours and does not count against the 14. It does not restart the 14. You would subtract whatever hours counted against the 14 since the last (2 hr) part of the split from 14 to get whatever he will have available. Sleeper split is complicated, which is why most drivers avoid it if at all possible. We are no longer allowed to split that 10 any old way we want to.

Your driver earned the log violation fair and square. Sorry.

 

I say if you think your driver was right take it to court. I know for a fact that lots of cops write tickets hoping most of the people will just pay them and not have the time to go to court. My wife has some polce officers in her family.
I hear the stories all the time.
