I was recently driving Northbound on the Grapevine in California. I wasn't speeding but trying to keep up my momentum. I was empty. I was coming up on slow drivers in the third and fourth lanes. I safely changed lane into number two lane then signaled over and got into the fourth lane. I saw a CHP with his disco lights on so pulled over. I was cited for Failing to be in the right lane. I have seen in the past other drivers do this. I know that you cannot remain in the number two lane but didn't know it was illegal to make a safe pass using this lane. Is this illegal to pass using number two lane? Will it be a heavy fine? Will this be as bad as having a speeding ticket on my record.

CMV's have to stay in right lanes at all times. I don't know what the fine will be, but being Calif. expect to be at least 3 digiits. Sorry about that.

And of course, when you do it, every trucker on the hill wants to get on the CB and tell you it's illegal. -
Last I knew, the law was the same.

1 and 2 your a ok, 3 and 4 well have a good day officer.
in california you have to stay in the right two lanes 1 and 2 THIS IS NO MATTER WHAT. most of us live with it the ones that dont say have a nice day to the officer a few times a year. -

Ca. counts the lanes from the left, so number 1 is the first lane next to the center divide. On a 4 lane in one direction highway, trucks can only be in the number 3 and 4 lane, Period. On a 3 lane in one direction highway, trucks only allowed in the number 3 lane, except to pass. However, a lot of cops will overlook this law if traffic is moving along.

It really becomes confusing for some drivers on the 710/5, 10/60 10/710 interchanges in the LA metro....
Running 710 N/B to 5 N/B you must get into the extreme left.....Most of the 4-wheelers won't let you in...and most won't let you back over once you have gone through the interchange......
What's equally frustrating are the 4-wheelers with trailers running in the "express lanes" or the carpool lanes....Many of those you'll see the Fireman decals on the rear windows.....
My nephew who is an OCSD deputy does it all the time pulling his toybox....His answer is he has a "Brass pass"......

Northbound 5 where he received the ticket it is marked for truck to stay in the right lane. It also has a solid white line, Technically they could write every slow truck going up that hill for lane and passing violations. It is not legal to cross a solid line for the purpose of passing another vehicle. Be glad they did catch you for speeding as well.
About 5 years ago I was trying top make a load appointment in Bakersfield, CA and got caught #2 lane and 68/55 it was like $600.00. I think lane alone is about $190.00.
