So it is your contention that the current drivers are incapable of running compliant? And as such would be incapable of passing an inspection?
Funny I've had 7 this year. I have been written up twice neither time bothers me (One was legit. The other chicken shiate but as yet still pending investigation), nor does the score or the percentile bracket I will fall into. I am quite sure I will fall well below any percentile of "failures" as right now 5 out of 7 were good, and none of the violations fall in the B.A.S.I.C.S. the FMCSA is concentrating on.
The only thing this program will do is shine a light on those with multiple violations. And like roaches they will scatter when shown for what they are.
CSA may save your future/job.

Without going into the gory details (while still wondering how many not-at-fault "violations" will cost you points), I've yet to see a big-Gov program have any effect at all except in that they end up costing everyone a lot more than they claim, and it'll mostly be an issue of control rather than safety.
Abe Lincoln wrote to Horace Greeley that if he could maintain control over the South "without freeing a single slave", he'd do it. Since then, and even long before then, I suspect most, if not all, major government efforts are designed to better centralize and control the populace. They just need a handy publicity tool. That wasn't my contention! But you do bring up a good point. How many of us are 100 percent legal 100 percent of the time?

CSA also doesn't make accountable the enforcers. Selective enforcement and using potential points to coerce drivers will be yet another tool in the less-than-savory LEO's belt.

That certainly is an interesting take on the subject! Please explain that further. To what purpose would the "unsavory LEO" coerce a driver?

guess what if you were written up even after your "investigation" it's on your record guilty or not ....mr dot man is now judge , jury, and executioner

They could replace you with cheaper labor now. Mexican cross border has actually been on the table longer than CSA2010. And right now the only defense we have against them is the lack of safety regulations enforced on their side of the border, and their sub-standard equipment. So if the goal was to remove you by compilation of violations they would be forced to apply those same standards to Mexican Carriers.
As I said this program has nothing to do with compensation. They could replace you tomorrow if that was their desire.
I run 100%. I know you will not believe it, and most just roll their eyes at the notion. But you must understand I am very greedy with my money. This means I never place myself in a position of having to part with it because of violations. People that risk their license, wallet, livelihood, and reputation to skirt the law mystify me. I can not fathom a situation that would make me want to pay a fine just to "get it done". I labor for my money and do not risk it foolishly by giving a reason for the government to collect extra!
I can not be coerced by anyone to take that risk. Appointments can be changed, relays can be arranged, nothing can cause me to pull broken equipment. It is a mindset that drives me. That same mindset assures people that I will do everything within my power legally to ensure on time delivery. And when I tell them we need to rearrange stuff that it is a necessity and not just lack of ethic, or drive.
Sure I might have a light go out in transit. But those are so few and far between and the fact that they are replaced as soon as I become aware keep those risks to a minimum. -
Actually no. But the infraction in question was written up on an inspection form without a citation reference(e.g. 395.1, 362.13...) number, and the fact that the warning does not fall anywhere in the FMCSA regulations we are asking for a ruling on both the warning and it's effect on my and my employers rating.
It has been removed for now. The entire record. We have received no official ruling as of yet, but the fact that it was posted and then was removed seems hopeful. -
You can mail that entire weeks paycheck to my truck. I am tracked by gps. And on e-logs. And have yet to violate anything (other then a few porcine thrones after bad mexican)
