All,
I worked for Hendrickson Trucking for over a year, the last 6 months I was a lease/owner operator with them and resigned 2 months ago when they started short changing me my money. Now when I have been applying at other companies they are saying Hendrickson says I refused to take a drug/alcohol screen even though I was not employed with them anymore...I have been driving over 4 years and I have no clue what to do..if I had actually refused 2 test it would be on my DAC and my CDL would have been suspended please help.
Is my career done?

I'd go to the state labor board over this one. They cannot give out false information on an employment reference. Plus, do you keep a copy of the Drug Screen? You might want to send them a cease and desist letter. We did that with a previous employer handing out bad information and it stopped.

I was no longer hauling for the company. I refused to take a drug screen that I was not aware of cause I was not working for them. And I have been told what they are doing is illegal they just do not want me to get hired again. -
you need to dispute the drug test thing. My guess is that Hendrickson DID put in on your DAC. Your cdl wont get suspended because somebody puts crap on your dac report. Your career isnt done, fight those s.o.b.'s and try looking for a smaller company that doesnt use dac until this is over with. or go right in and tell whoever you are applying with that they are saying this and it is not true. But personally I'd go with a smaller company, same BS just not as much of it to deal with.

If you have proof that you were not employed with them at the time, contact the DA office in their area. They would probably state they made a mistake, but that would certainly get their attention. It's not like an employer can just *lie* like that and get away with it.
Maybe you can get some money out of them, you certainly would have a chance to do so. -
I agree with you that they SHOULD NOT be able to get away with this. And there is certainly grounds for a defamation of character law suit with malicious intent on the part of Hendrickson ONLY IN MY OPINION. I am not a lawyer but I think a good one would come away with a victory for you.
But I think from the original post that he wants to go to work and I applaud that!! Personally a law suit is something of a last resort there again in my opinion. I'm sure someone will disagree and that's fine, that' why it's America
