Drinking limit

    Simple answer. Drink, then don't drive. If you must drive, then don't drink. It is NOT worth losing your career over.

    What you may not realize is that the limits whatever they are in your state for your type of license just show "presumed impaired." What this means is that if your BA is over this limit, you will be presumed to be impaired!
    However, other factors come into play here. BA is certainly NOT the only way to prove impairment. Driving pattern which basically establishes probable cause for the stop in the first place, physical appearance, speech, ability to perform field sobriety tests, and other stuff can lead to a DUI arrest, even if you are actually way under the "legal limit."

    I can't answer for anyplace else, but in California DUI=DWI. Same thing. Also, it has been many years now since they would allow a DUI to plead out to a "wet reckless."

    Of course that does not mean that it has NEVER happened since then. It just is not legal any more. . .

    I live in NY and it's .04 in any vehicle when you have a cdl. But here we also have DWAI, driving while ability impaired. It's not used a lot but they can bang any driver in any vehicle for that with a .04. But I agree with pretty much everybody else. Pop the top and lock up the keys. It ain't worth it.

    I copy/pasted this from MD MVD...this is one of a few states that give a little separation to the "vehicle type" being operated. but they do recognize the .04% while operating a commercial vehicle.

    This is taken from the Illinois CDL study guide section 1.13:
    "The illegal BAC limit for a CDL holder operating a CMV is .04% and .08% for a non-CMV"

    In VA it is .04 in ANY vehicle....If you have a CDL or CDL permit....If you have .02 they will put you out of service for 24 hours! Why risk it???

    i see this all the time...........now, NOT speaking of the original poster mind you, but the total disregard fro the CDL and the rules we MUST follow to keep our jobs. when in school, i get it all the time, "yeah, but i'm home its my weekend, so what if i "do a little weed", or "so what i get stone cold drunk, then drive"..........whatever.............

    many these days do not really care about their CDL, all they want to do is party like there is no end. many these days only want to get off unemployment and wouldn't really want to be a driver for more than say a few months till they get another job.

    i hold NO respect for many students these days, as many are deadbeat, punks. that's all many are..........stupid, ignorant, uneducated PUNKS...........and these arse's think they actually have a shot at getting a job........i laugh so hard...............

    Go on ahead and laugh. Most of them have a better shot at getting a job than some of our seasoned vets.
