Trying to gather as much information as possible on Trucker's Express, based in Missoula MT and incorporated in Delaware. I want to be certain to be included in any bankruptcy proceedings that may be underway, but have not yet been able to determine their status, other than their bond was cancelled and they owe a considerable amount of money to a great deal of carriers. Rumor has it they have re-opened under the name Triple L Logistics. If anyone knows anything about their relationship with Trucker's Express, that would be helpful as well.
Anyone know if Trucker's Express has filed bankruptcy?

TEI does not owe me money, but I am close to some people that have outstanding claims.
No form of bankruptcy protection has been filed as of yet. They are currently liquidating assets in order to pay their secured creditors. This STINKS to high heaven!
A few folks I know have withdrawn their bond claims and are going after the shippers for payment, with some degree of success, I hear. -
Thanks for the update. Just to alert other out there, some of the principals of Truckers Express have opened under the name Triple L Logistics with MC#585128. Same dance, different dress....

They have actually filed it was about 3 weeks ago. I know because a friend on mine got the paperwork.

TEI got me for 6K + permits. I moved an oversize CAT bucket from Aurora, IL to Eureka, NV. I doubt I will see my money. I am trying to go after CAT and the reciever.

NightWind, I would be interested in knowing who to contact about their bankruptcy. I have not yet received anything, but perhaps your friend was on the carrier side? Any information on who to contact would be most helpful.

On August 28, 20007 an involuntary petition for Chapter 7 bankruptcy was filed in the Federal District Court in Montana by the following Claimants: XTRA Lease, Melco Transfer, and Admiral Merchants. Federal Express has also filed as an additional creditor. IBM Credit has also requested they be included in the cause. Case No. 07-61004
If you or anyone you know have outstanding invoices for freight bills against Truckers Express you may file at no cost (and without a lawyer!) to be named as a creditor. You can get the PROOF OF CLAIM form at http://www.uscourts.gov/bkforms/official/b10.pdf which is only one page, very simple to complete and only needs to be mailed with supporting documents.
As of today, there has not been a trustee appointed. The companies mentioned above who initiated the action have specific deadlines to meet before the case moves forward; that does not mean that there are currently any deadlines imposed on submitting PROOF OF CLAIM forms.
I spoke with my attorney today, asking specifically about the involuntary action. He stated it is unusual (as apposed to a voluntary action initiated by the debtor), but the bankruptcy code does allow for creditors to force bankruptcy on a debtor in an effort to gain some relief. There are basically three cl***es of claimants:
1st priority is SECURED CLAIMS meaning those secured by collateral.
2nd priority is UNSECURED PRIORITY which are specifically related to wages, domestic support obligations, contributions to employee benefit plans and taxes/penalties owed to the govt.
3rd priority is UNSECURED NONPRIORITY which involves debit with no collateral or lien. This is where freight bills will be classified.
The attorney representing TEI has already responded to the action with a counterclaim stating that XTRA LEASE "is not an entity qualified to commence an involuntary action against this Debtor". Of course they are seeking damages.

Good morning, I am writing in responce to 2 things on this thread!!
First ( Triple L Logistics) Was an agent for Truckers Express! Triple L is owned by me and I like many others are owed a great deal of money by TEI.
Second You are correct in that TEI is being pushed into involentary bankruptsy. But there is a change of plan. Xtra Lease claim has been disallowed due to an inconcistant invoicing from them. As your lawyer may have told you it requires that 3 business come forward in a court action to continue. Triple L Logistics has joined the petition as of Thursday October 4th 2007. The NEW court hearing is set for Tuesday October 9th 2007 at 9am. Please feel free to contact me if you need any other information. Thank you

Is it too late to file a claim? I found this thread doing a google search for information on contacting the company regarding a medical DOT/Drug Screen one of their drivers had done at our clinic - and of course has not been paid yet. I have printed out the form and will be giving it to my manager (as well as the thread) and hope to have this filed also.
