after reading the article.....I really feel for the guy. Aside from the crap that company is putting him through, not much mentioned in the way of his emotional well being.........I hit a pedestrian 3yrs ago, in my 4 wheeler, she was an older lady with a lot of health problems. She was trying to kill herself, and b****d to both me and the cop who witnessed it, "why didn't you kill me?" The light had just turned green, and my speed was maybe 20 - 25 kms.
She was taken to the hospital.....and released same day. She was fine other than being admitted 2 days latter to a looney bin.....so I'm told by the witness cop. There wasn't criminal charges, but it shook me up for weeks.
Honestly? I joke about it now as it is my "tough" way of dealing with it, but still bothers the hell out of me.

The gentleman in the article.....aside from pay and record of course...it's a hell of a thing to deal with emotionally.

Hhhmm....I worked for Glen Moore, and found them to be a straight up company, but the fact that the guy had a negative balance, which I'm sure was documented to OOIDA doesn't speak well for the company, because otherwise, he couldn't have been negative. I believe the driver's story.

Them firing him for this stinks too. Who could avoid someone like this woman, hell bent on killing herself? You just don't see people in the middle of the interstate like that, nor could you avoid them as it was described either, without having terrible consequences.

The sad thing here? Had he just mowed her down and put the woman out of her misery, he's still have a job. But because he spared her life, the company will likely reward him with a black mark on his record.

I hate to say it, but he needs to go after them with guns ablazing...'cause that's what I would do.

And this is something I just don't get! A driver misses something in the road and wrecks the truck they get a "black mark" and "fired" that is bull crap in my eyes. It is human nature to miss something in the road and if it is a human life all be darn I would swerve to miss it. The black mark is darn worth me losing my career over if that's what it must be. That woman may have been having a bad day and if she survived maybe led a happy life and I would be part of that. Now on the other hand, I could be her new focus on life and she may want to kill me because I did spare her life. Most of all though I can't believe when I hear a driver gets fired/written up over him avoiding a life of some kind and wrecks the truck (If proven to be true). That is sad :(

I am not swerving for ANYTHING!! except for another large vehicle.

I wont swerve off the road and into potential injury to myself for the following things.

    1. All animals.

    2. People(including babies) wandering in the road.

    3. Cars backing into the road.

    4. Cars coming head on.

    5. Motorcycles.

Now, if i was to have been daydreaming, and was fast approaching stopped traffic, with no time to stop, then i ditch it, but if it is not my error, I hit the object in the road 100% of the time. That woman would have been my new hood ornament, I would have safely stopped, and sat in the rig till the emergency crew got there.

The reason this company booted him, was he is opening them up for a potential lawsuit. If he inspected the brakes and noted it to the company and still operated the vehicle, he was wrong too. It is YOUR responsibility to inspect the truck, and based on the inspection, it is your RIGHT not to operate a vehicle you feel to be unsafe.

If you hit her, you get a nice permanent mark in your record. It was a lose-lose situation.

Rather hit her and get a mark, than drive off the road and hit an immovable object and be dead.

I would get a lawyer and sue her family for loss of future wages, based on her intentional actions, and me getting a mark for said actions.

Actually, hit her & you may end up Bubba's cellmate for 15 years for manslaughter.
