new driver in trouble

    upon trying to get home (1.5months out) my truck was recalled to a main terminal and i was discharged. later my dac indicated that the termination was for "excessive complaints".no benifit of writeups or talking-to's or qualcom related warnings or advice. question is what should i do to try and restart my career? :biggrin_25521:

    upon trying to get home after 1.5 months out my unit was recalled. later i found out that my DAC sez i was discharged for "excessive complaints" w/out the benifit of qualcom message warnings or formal writ-ups.not even a phone call. this is the kiss of death when seeking employment, what if anything can be done ?

    the company was western express,and getting home in six weeks out is not complaining.

    Excessive complaints??? WTH is that? You b****ing too much about your company? Heck, that's a driver's second favorite passtime...right behind looking in four wheelers for naked people...


    Seriously, though...what does the company say the complaints are for and what company is it? Without written documentation, I really don't think they have a leg to stand on. Unfortunately, all you can do is tell your side of the story. Once something hits your DAC, it's like pulling teeth out of an alligator to clean it up.

    So yes, you were complaining......However, I don't think many drivers would consider it unreasonable, unless they have a horrible wife that they don't want to go home to. I think if you call up small, or big companies, tell them the truth, tell them what you're looking for. Some will offer it, some won't, but it should be no issue.

    you HAVE A POSSIBLE case for unemployment benefits and a possible lawsuit, CONTACT a lawyer...........and next,

    what you NEED to do is contact USIS (DAC) and give a statement.

    look for the "dispute form" then print it up and fill it out,

    then you will have to photo copy your drivers license, AND social security card, and mail that ALL to them. they will send you a new copy with your statement.

    "excessive complaints" in MY BOOK, does NOT warrant any adverse job actions. you should do fine in finding another job. i would also type up a nice, neat, punctual, accurate account (in 30 words or LESS..!!) as to what this is all about, and include this letter in any application you fill out, as a "precursor" to the new employer, before they get the DAC report.

    there is something called "DACFIX" # www.dacfix.com and for a fee, they might be able to get that stupid shiot off your report...........

    i gotta tell you.........that sure is a new one for me..........!!!!!!

    and frankly, i am wondering if you can collect unemployment now, as an unreasonable firing offense........give that a try too.........because in some instances, the employer WILL NOT look good, for any unreasonalbe firings. make sure too that you read thru your company handbook, and see if such "excessive complaining" is just cause for firing.

    Maybe by "excessive complaints", the company was not referring to the driver complaining, but the company receiving excessive complaints from shippers/receivers about the driver?
