Prime and a dirty UA???

    The test was done at driver line-up by Mark (I think that was his name), nice enough guy....but he has no problem suggesting that I walk around the main terminal or do whatever. He said as long as I was able to give the rest o the sample within three hours.
    As for the temperature he did test that on both samples then proceeded to mix the two together....and yes I did in fact initial the two samples agreeing that everything was done right. I never really thought about it at the time. So My bad there for sure. He asked if the social matched and the numbers matched and I put my initials on it agreeing they did. Iguess I can only hope that Mark willbe a stand up guy and admit that this was in fact taken at two different times, (within the three hours) and that the urines were in fact mixed cold with warm.

    Everett, please don't misunderstand this post as me "bashing Prime" in anyway. Things do happen and that's just what it is, not sure if it's how the sample was taken or the aleve and midol I was eating like candy due to Aunt Flo's visit that caused all of this. They are a decent company to work for if you can keep your foot off the pedal, if they weren't I would not have been looking to go back with them. :biggrin_25525:
    So please don't let my mishap keep you from jumpin over there, just make sure you give them more urine than they ask for the first time. Lol

    I replied earlier but still don't see my post up, so I hope this done't turn out to be repeated information.
    This test was done at driver line-up by Mark, (pretty sure that was his name), nice enough guy....but yes he had no problem telling me to go walk around the main terminal or whatever until I had to use the bathroom again. So I did! You are right though, I did sign on the dotted line when maybe I shouldn't have looking back. He asked if all the numbers matched, they did...so I put my initials on it and it was sealed.
    As for the temp, he took the temp on both samples and it was after that when they were mixed. I did say something, I asked if it was ok to do that and he assured me it was. My bad again. Mark was a nice enough guy, and I would think he would not deny how the test went down if questioned by safety. (one can hope anyway)
    Everitt, please do not misunderstand this post to be "bashing Prime", things do happen and if they were a bad company to work for I would not have been returning. Just keep your foot off the pedal and you will make money. Lol

    So I had this idea while getting ready for work this morning, I think I will offer to take a hair test (at my expense) to prove my innocence. A;though it would be nice if they reimbersed me WHEN I pass, I would just be happy to have it all go away ya know? It sucks because I have long hair and I did a hair test years ago, while it's true you can's see where they take it, you can darn sure feel it and it drove me crazy for months while it grew out. However, if that will clear my name then sign me up!!! Ha

    Ok, I'm confused. Was this a pre-employment screening for you coming back to work, or was this a random. The only reason I ask, is that the guy you said took your test is one of the overnight guys who works in Lineup, and it seems odd to me that he would be doing a pre-employment screen, which I would think would happen sometime during the day.

    This was a pre-employment test and not a random, I thought it was rather odd that they had me go to driver line-up (after business hours) rather than the clinic in the morning. ESPECIALLY since it was a guy who was in the room with me and only a stall door seperating us.
    Talk about an awkward moment! Lol :biggrin_2556:

    Something doesn't add up here. If everything went as you say, you need to get a lawyer that specializes in this kind of thing ASAP. I mean, yesterday. Yeah, it's going to cost you, but if you have any interest in clearing your name you'll get a lawyer involved. Getting information about what to do on an internet forum or through Google just isn't going to cut it here. If Prime is finished discussing it with you, get an attorney....now.

    It's easy for people, myself included, to assume that you're another person who legitimately failed a drug test and are now trying to find loopholes and wiggle yourself out of this. But unfortunately, false positives are far more common than people realize. Everybody thinks it won't happen to them. You very well could simply be another innocent victim of the ridiculous failing drug war we have going on in this country. But enough about politics.

    Many things could have caused a false positive for you. Just about any over the counter pain killer (including Advil, Aleve, Tylenol, etc.) can show positive for THC in the right individual.

    The unfortunate thing, is they won't take your word for it. Heck, DOT doesn't allow them to take your word. You absolutely must get a professional involved here, especially since protocol was quite obviously violated.

    HOWEVER, you need to find out what type of test was given. From what I remember, the pre-employment test is initially done as a "panel test" which is where they simply dip a stick into one of the samples. The stick will change color or show a line indicating what type of drug you tested positive for. This kind of test can NOT distinguish between a real THC positive, or a false positive from something like medication. What they probably want you to pay for is to have your second vial sent in to a lab where they perform a "GC-MS" test. This test CAN distinguish between the real thing, and a false positive. It is very expensive (which is why employers don't just do this from the start), but extremely accurate. Pay the $200 and have them send it in to the lab. If you are truly clean, this test will prove it, and then you can start screaming for your money back from Prime. But if you're truly guilty of using marijuana, save your money. The CG-MS test is accurate enough to use in a court of law. Once you're found dirty on that test, it's all over for you.

    I still recommend you get some serious legal advice before doing anything anybody here says though.

    I do have to say, during my pre-employment screen, it was nothing like what you described. The drug test was done during the day on the first day of orientation right before we did our physical exams. The sample I gave was put into two separate vials in front of me, which I initialed. I've never taken a random.

    Hey Mike....I hear ya! Maybe if the doctor would have explained it the way you did when he called I would have better understood the reason for paying the 200.00 to test the same sample. He honestly made it sound like a ridiculous waste of money, but that if I wanted to "go there" it was an option. Sounds as if it would have been much easier, cheaper, and quicker that way.

    Honestly I haven't talked to Prime about it, as I said in my original post the Doctor called and was a DICK....and I just fell apart emotionally and drove home wondering why all this happened? I didn't understand any reason for any of it happening, I just knew that it was and I didn't seem to have a leg to stand on. I humbly went back to my old job for 11.50 an hour working locally and we agreed I could work overtime to compensate for the pay. Everything was just so depressing and overwhelming at the time. (especially with the divorce)

    A lawyer would be great but I am up to my ears in debt....which is why I emailed fixmyDAC.com (still no word from them) I figured a couple hundred I could do, but I am sure they have no sample left of the original urine now. This is why I thought doing a hair test is my best bet. I am going to go to a lab sometime this week and pay for a hair folicle test and try and fight this that way. They say hair test are the most accurate and go back like 90 days, if I get it done someplace like LabCorp where they know it wasn't a little home deal they should consider this. Then I am going to send a certified letter (with the lab results) explaining exactly how all this went down, and politely threaten to hire an attorney that I really can't afford. Maybe even talk to DOT directly....don't know, just know that money is a huge issue in my life right now and lawyers are expensive.

    I have wanted to call Prime, but again I have nothing to offer them except the fact that I took medication for "that time of the month" and the urine should have been collected completely differently. No where near enough to overturn this thing. So I am trying to arm myself with hard core evidence then hit the safety department with all I have and pray a lot!!! It's the best I can do right now.

    Not sure if you actually took a "DOT drug test" or simply a "pre-employment drug screen" but if it was a DOT test, that link should prove helpful.

    I'm not sure that obtaining a test on your own will do much good. I wouldn't spend that kind of money (hair testing can be quite expensive if done at a lab) unless you know it'll help. You really need to make some serious contacts there at Prime. Time is certainly not on your side.

    Whether you actually used Marijuana or not, take a moment to consider where Prime is coming from, even if the procedure went as you stated. On paper (remember - it's what you can prove), you were going through the hiring process, took the drug screen, and popped positive for Marijuana. End of story. They ding your DAC, just like they have done for the hundreds or possibly thousands of others who have failed the drug screen before you. They're going to go about their business as usual unless you become vocal. And even then, they won't believe you. This is going to be an uphill battle, especially if you can't afford proper consultation.

    Prime may be required to keep samples for a specified period of time. I don't know. But if that's the case, you need to hurry up and make sure that sample isn't destroyed.

    Mike you seriously saved my ### here with that link and I can't thank you enough!!!

    Although I am still going to go through with the hair test "just because" it will reiterate my innocence to Prime and all other parties I may go to work for, but the test did in fact break DOT guidelines. Under the subpart I- Problems in drug tests section 40.193 it says "What happens when an employee does not provide a sufficient amount of urine for a drug test?" Answer is (1) Discard the insufficient specimen, except where the insufficient specimen was out of temperature range or showed evidence of adulteration or tamering!

    The first specimen was normal temp and Mark then told me to drink something to finish the test within three hours. When the second specimen was collected it was added to the first, not replaced by it. When the doctor from the lab called me, I did manage to get the part out about how the specimen was collected and he did say he would add that to his notes when submitting the test back to Prime. As long as Mark is the "stand up guy" I feel he is, and the doctor did what he said he would do, I should not even need an attorney. The urine should never have been used according to DOT regulations. I will certainly keep you posted as to how this all plays out, but I feel it is going to be just fine. Trying to find a few minutes to get hair test done in the next couple of days.

    You can submit an appeal and possibley retest with a hair sample.
