My driver just called me. Truck jacknifed right in front of him. Driver of other truck is fine his truck is a mess.
To avoid accident my driver slammed on his brakes and flat spotted all 8 trailer tires.
My question is this can I go through the other drivers insurance for tire replacement?
My drivers statment was the other driver went to close to the edge and his steer tire dug in the soft shoulder and that's all she wrote.

Other driver taken away to jail for falsifying log book. -
According to the DOT, you should be able to safely stop your truck in any instance if your guy wasn't following too close or speeding.
If they are ABS, they shouldn't of locked up.

They wanted to charge my driver for following to close.
My driver asked them why. I stoped without hitting him?
According to the police, because my driver slammed on his brakes!
Ok, I'm I missing something here. I thought human reaction is if some body jack knifes in front of you or get's in an accident the first thing you do is "Slam on your brakes" -
That depends on if you are in the same lane as him.
Trailer has functioning ABS there is no "ABS light on" in the dash or on the trailer.
However he did flat spot the tires. -
If the driver had to hit the brakes hard, then the driver may have been following too close.
However, if the other truck was just passing and returning to the lane and then jackknifed then the driver was not following too close. -
You can only be charged with following to close if you get involved in the accident.
If you stop with plenty of room to spare means you were not following to close. Everyone reacts differently to an accident in front. -

You have alot to learn.
A driver can be charged with following too close even when a car pulls back in front of him and the officer did not see the car make the lane change and sees the truck too close.
