    i have never been bothered in ny--doesnt seem as bad ohio---one place is almost the same as the other--just keep your crap together and generally you dont get bothered----and i think the leo must be really looking for --the truck stopped in time--didnt hit the other truck--or go out of control for the most part--you would think he would be looking at what could have happened rather than what did happen---
    i think the driver did a good job in stopping--others might not have been so quick to stop

    ok, on with some real remarks!

    Did your driver take pictures? If not ask for copies of the state police's file. Look at where the ALL the skid marks are and where the lead truck came to rest.

    A jackknife on 2 lanes of road is always hard to avoid but your driver stopping in time means he wasn't following to closely but darn near to the proper distance!
    Use the pictures and your lawyer or YOUR insurance company to file and get payment for the tires.

    A TIP for everyone:

    A picture is worth a thousand words!

    Almost every one of us has a cell phone with a camera!

    EVERYONE of us has a disposable camera that the company gave you for just such an emergency! If not you really need to issue them!

    If something happens that you might be a part of like this that camera should be IN YOUR HAND and the first picture is towards the accident!

    Hopefully it caught the tag of a car that could have seen this accident and now your insurance company has a lead!

    Then take at least 2 pictures from each corner of the truck.

    Then get pictures of ANY skid marks with some views of a yellow or white line as a reference point, pieces of car or truck and views from maybe 100' away.

    Pictures of the other vehicle but DO NOT take a picture of any people that are dead. Bad form! But take pictures until you run out of film or space on your card. Another tip later.

    Evidence is what you need and in the OP's case if the driver had pictures of his skid marks AND the skid marks of the other truck, this is a case closed and in your favor deal!

    Let your insurance company do the work, that's what you pay them stupid money for! And lawyer up if you have to!

    TIP: I bought the largest memory card that my not so smart, smart phone could handle. 8 gigs is an awful lot of pictures. I also carry 2 disposable cameras that the company supplies. I insist on that as some of those Keller throw aways don't take as many pictures as the dial says or the heat of the truck could have ruined the film! I had to use both and I am glad I did as mine didn't show a thing! But that shows how long they were in the truck before I needed them! A digital camera is also a good investment! You can never take enough pictures at an accident scene!

    One other tid bit would be the first picture you take is through the windshield and side windows showing dust settling, passing cars and you trying to get tag shots.
    Dial 911 when you get to the other vehicle so you can give vital health information to the dispatcher.

    Not to many people know this:

    Dial 911, TALK NORMALLY AND CLEARLY.
    Give your PHONE NUMBER FIRST! (in case you drop off)
    Give your name
    Then give your location and all other information like,
    Accident involving an 18 wheeler and 4 wheeler,
    Location as close to a mile marker or town on road number.
    how many injured persons,
    then answer questions from the dispatcher.
    If you hold an EMT Cert give them that info but you guys already know that!

    If the dispatcher wants information in a certain manner they will stop you and lead you through what their steps are.

    Keep calm! Don't yell into the phone and yes adrenalin makes people go into shout mode!

    But the main thing is to keep calm because people under stress subconsciously think yelling and talking fast will get the message through that it's an emergency. It doesn't.

    Every 911 dispatcher knows when that switch board lights up it's a 97% possibly that there is an emergency happening and they don't need to calm a person down to get the information when seconds do count.

    The other 3% we get to hear on you tube or the news on how stupid drunks or morons can be!

    Now, let this be an example of why a safe following distance is a good thing! He got stopped. Yes this officer might be wrong BUT those pictures you have will tell the whole story! Thats a GOOD thing when it's your CDL at stake!

    But OP, let your lawyer and insurance weenies do their best!

    So you don't push your drivers but they lose the truck if someone can get more miles? I'm so glad CSA2010 is going to put these lone gunslingers out of business.

    Has anyone heard of the term "Tailgateing"? You don't need to have an accident for that. Following too closely shows the police that you are aggressive and are not leaving enough room to make quick decisions if the situation should arise. I drive through I87,86,88, and I90 several days a week with no issue. I passed a level 3 2 weeks ago and the DOT officer was very friendly. I'm not saying there aren't jerks there like everywhere else but if you act professional you most likely will get that in return.

    :biggrin_2556: But up in wis , just south of mantowac , wi, i took off on a shortcut on a two lane blacktop, now i just pickup the load at mantowac yard and i knew i had hours too run it down the truckstop, well it never made it that far, for you see boss hog and rosco had a trap set up in the hill's, i was going up and down the hill's just fine, not rushing, just taking my time, no hurry , so i go slow , not knowing were i am , i had plenty time too get the load there, i picked up this road from anthor driver there at the yard, anyway this bright blue van comes up behind me at high rate speed, cause he zoom on me quik, i was doing the 55, sometimes 45, as i went up and down,fully loaded , heavy,so he passes me a certain spot,on a double yellow, then slam the brakes on , i saids o-geesh , i didnt panic stop , but press on the brakes to slow enuff not too hit him,but barley miss him , my front steer went over the yellow double next thing i know i see a maron color car smoky beer coming off side road with lights flashing, i got a ticket for folling too close and i was allready pulled over too shoulder by then , cause i wanted too check out my truck and he gave me a ticket for 6 inchers over the yellow line , i asked how he knew i was 6 inches over the double, well i said this in my normal voice not mad or anything, he gets all mad , how long you been up, i tell him and i tell em im hitting next truckstop for my next break, he proced to say , no your not , your going too the farmer elevater here and park it , i said ok works for me, no he was just a city cop,then as pull awy , i see the both them jabber away at each , laughing and carring on, so i wasnt placed out service, then about 1 am i hear this knocking on my door , i thought as any here driver will tell you , when there half alseep it was a dang lot lizard, i got up went too door , same cop , if you dont turn this truck off, i was idling first time in a long time, it was cold out, im gonna give you anthor ticket, i just said no problem, i was close enuff too morn it would start, so i have those tickets on my dac thanks wis, and driving record, :biggrin_25510::biggrin_25516: Everett.

    Guys that have never had an issue with a dot cop in NY thanks your lucky stars because theres alot of them in that state and you will get one sooner than later, the states need money and we are the cash cow more than ever. And as far as this acident we dont know all the details so the bashing of this driver and company are premiture, i've bin in this same situation in CT where a car loast control in the right lane i was in the middle lane spun across both lanes in front of me and then pulled back to the right shoulder i had to take the median to miss the car and guess what after the cops showed up the car drove away with no tickets or nothing but they proceeded to read me the riot act about the damage i could have done if i hit the car or went throught the guard rails, in the end none of us
    were there and know what happened so how can we assume he was tailgating, the driver stopped with out getting involved so as far as i concerned he was not tailgating the cop is seeing extra cash buy righting another ticket.

    It is obvious that his reaction time was cut short for him to slam that hard on the breaks to flatten his tires. Maybe he should take a SMITH SYSTEM class. He should have been looking down the road for potential problems. You can defend him all you want but I see veteran drivers all day long talking on the cell phone or filling their face hith a big ole sloppy sandwich while driving with their elbow. Slap the cuffs on him I say.lol
