Magnum,
How do you want me to fine the company for something a driver did? I could care less about going to court, I go at least 5 days a month. Some State's can't even write the carrier the overweight ticket. So how can I violate the State's rules and regulations to please you. Then I guess what you as a driver needs to do, is work for a decent company. If you lie with dogs, you get fleas. I can not help what a carrier puts on a DAC report. I can't help what a company suggest you do. When I go in and assist on a Compliance Review, I can issue citations to a carrier. But to issue a carrier a ticket at roadside, when they are no where to be found it can't be done in each State, maybe some State's allow it, but all the one's I know of do not. I understand where you are coming from and have talked to many driver's that are in your shoes. I have also used them as a source of information for the auditors to reach out to and gather information on a carrier. It's a bad deal, but to say I am not doing my job, I don't think so. You either have a set of nutz or you don't. No one can make me violate a law or anything else if I don't want to. Each man has decision. You say "No" and if they fire me, so be it. Sounds like a wrongful dismissal if that's what they hang their hat on, wanting you to violate the law. Now if you are a problem child that has issues, they hang their hat that you did A, B and C. You sound like you have morals and a set, but you know as well as I do, no one can force any man to do anything he doesn't want to. Maybe you need to contact the authorities where you work, whether it's the State Police MCSAP unit or FMCSA to file a complaint on the carrier. As far as DAC, I have no clue who, what , why or how a carrier puts stuff on there. My suggestion is to have the carrier put it in writing what they want you to do. I would put my response to the carrier in writing and send it via email so there is a paper trail from the beginning that will always be available to anyone including your attorney(s). This would probably help you as well dispute the DAC information should they put "trash" on there.old-six-pack and Rerun8963 Thank this. -

I got fired two days later same truck same bald steering tire "THAT I RECEIVED A TICKET FOR. "some other guy is driving the same truck down the hiway I called the D.O.T post 10 miles away. Guess what they said. "WE CAN'T Do ANYTHING. So Guess what I'll drive with bald tires lights missing and I' will not write up anything. Thanks to the TX. D.O.T.Don't try being all high and mighty.
-
Was the tire out of service? If not, it still has to be corrected before re- dispatch. I have no clue why the authorities would not look for this carrier or vehicle. I see this at least once every few weeks, from a "concerned driver". I didn't say I was high and mighty. From the sounds of it, it seems I hit the nail on the head about what type of company you used to work for.
-
Yes tire was out of service. That is what the officer said that gave me the ticket. The ticket said the repairs were to be made and the mechanic or some one had to sign a paper that said they replaced the tire before the truck was put back in service. Yes I drove it two more days before I quit
and returned to the yard several times. and may have been a week before it was replaced. "just from what I heard from fellow employees"

I have a new job. Guess what they told me. " if there is anything wrong with your truck don't write it on the post trip. Now after going through a couple of jobs doing it right. What should I do!
