DOT FINES

    my husband left the company he worked for 10 years a month ago ... DOT come in and audit them well they got my husband on a voliation but we have heard nothing from them yet this was 11-1 ...now the company is holding his escrow till the fine out if he gets fined or not...how can i find out if he has a fine and does DOT send the fines to the driver or the company cause im getting tried of waiting for this escrow when its not the companys place to hold it they held it for 30 days now...thanks

    WOW...im a newbie and this scares me. I know you are to keep tax records for 7 years...how long "back" can DOT go? And your ?-does DOT send company the fine or straight to the person??

    That's a strange situation. I would think they would send the fine to your husband rather than to a third party. I would call the DOT and get answers there.

    Are you sure that company is not feeding you a line to keep the escrow?

    well im thinking that too CondoCruiser but im a little smarter than they are cause my lawyer has already been noticed and he is waiting....it was a outlaw company and after 10 years my husband got tired of driving and having to "fix" his logs every week...so he got a trucking job where he runs legal and is home for 12 hours and drives for 12 hours...

    Earth Angel i think they only go back 6 months on logs I THINK that is all the farther back they went at this company anyways....

    How long ago was the audit? I'd contact the DOT in the state that the company resides and ask about it, since your hubby's record is on the line here.

    OK, this is my understanding of DOT audits from a small company I worked for many years ago. I was Buddy Buddy with the owner and he told me everything about his company, even his financial status and how many millions he had in the local bank !
    If the DOT finds discrepincies with a drivers log, for instance, the company gets fined as well as the driver. However, normally only the fines are collected from the company and not the driver, since most drivers are pretty broke and have no $$$ anyway. These fines are collected almost immediately after the audit. I would demand from the company any paperwork from the DOT showing your Hubby was fined.

    they havent heard anything from DOT yet and this happen the 1st of Nov. they said it would be 10 days now if it was 10 business days it would of been the 17th if it was just 10 days it would be the 11th so either way the 10 days is up...there is a guy that is looking at a fine cause he did his logs as he pleased now they have to fax his into the Federal DOT everyday...so if my husband does get a fine and the company is suppose to pay it and she take it out of his escrow i can sue her then right....

    What's a log? Sounds like a good way to get in trouble.

    Sounds to me that if it was caught during an audit, then the company should have caught it first, so they should be liable.
