Firearms in truck

    Are you talking about Jason Riverburg? He was parked at a gas station in South Carolina, where they have pretty sensibly gun laws. There wasn't much news about this one, but a truck driver here in Knoxville shot and killed a guy that broke into his truck. Here's the story.

    I'm all for the right to carry, but you better be doggone sure you're right when you take a pistol through some of these places. Maryland's laws, for example, make it illegal to transport a pistol except in very, very, limited circumstances. Yeah, that Federal law trumps local law, but that's not going to keep that bigshot 23 year old cop from arresting you.

    Yes he is who I was talking about. I just couldnt remember were it was. As for driving into other states the truck I will be back into on the 7th of december, can only go so fast. I tend to go at or a little under the speed limit in the city limits, so there is little to no reason for johny law to pull me over and search my truck.for me this is a personal thing, carry or not.untill the DOT says different I will.

    I'm definitely telling you not to. I do-but I also don't go anywhere that it's a problem. I don't think the DOT (or the FMCSA) could pull off restricting second amendment rights.

    The article left out the good stuff...I kept up with that story the best I could when it happened...no charges were filed against the driver (at least none that I heard about)...

    I just went through a little theoretical debate with an instructor on this. Come to find out there was a federal law against carriage of firearms in CMV's back decades ago but was repealed in 1968 because it was unconstitutional. The instructor thought it was still on the books...

    In any case, I say theoretical because pretty much all carriers will CAN you for carrying and DOT can always inspect your cab. I have a permit but I don't want to risk loosing my job or having issues with a cop or state with an agenda. I think I will just carry the wasp spray in the truck.

    I think there should be a federal law stating that truck drivers are exempt from BS state laws so long as the firearm stays in the truck at all times and the driver goes through a training course to certify competency. That is my opinion, whatever it is worth...

    There were no charges, fairly common sense folks around here when it comes to stuff like that. (edit) Oh yeah, you're from here too! Here's another story.

    Do you still have this instructor? Tell him I've got a hundred dollar bill with his name on it if he cares to prove that law ever existed. I guess when someone makes up a date, it sounds more believable. You can PM me for my contact info.

    I hear you point on the Federal law, but I don't want the Federal Government to get in the habit of writing more gun laws, they've already got plenty. As far as the gun staying in the truck goes, I think that's a terrible idea for a couple of reasons-First, I think you're more likely to get mugged on the way from your truck into a building than when you're actually in your truck. Second, do you really want the guy that breaks in your truck to steal your computer to wind up being armed too? I sure don't.

    Just stay away from checkpoints, border crossings, immigration........

    remeber, some dogs are trained to smell out firearms !!!!

    So are you suggesting that one should be able to walk inside a truck stop with a loaded pistol? Or are you saying one shouldn't carry a gun at all?
    As for Jason Riverberg who was shot in South Carolina. I believe he was shot from outside the cab of his truck while he was sleeping if I'm not mistaken. I could be wrong about that though so if I am let me know.

    No they are not. My close friend is a K-9 handler at the Nogales,AZ check point. The dogs are trained to semll for people, drugs and large quanities of money.
    Firearms ammunition will not alert dogs trained to detect explosives. MAybe extreemly large quanities would.
    I aksed my friend about this for the very reason being discussed in this thread.
    Now if you want to roll through the checkpoint with 10 tons of pot in the trailer , now thats a different story,:biggrin_25513:

    I don't cross borders, but I've never had a problem with the immigration folks coming out of Laredo. Of course, it's perfectly legal for me to roll up US59 with a gun on my hip.. How would a dog smell a gun? Residual powder residue? Just curious, I don't doubt it.

    Yes, I'm saying that you should be able to (and I do) walk into the truckstop with a loaded pistol. In fact, I don't do business at that TA on the west side of St Louis for that very reason, they have a no guns sign on the doors, which they have every right to have, but they apparently don't need my business either.

    I thought I had read Jason Rivenburg was shot after his murderer broke into his truck and stole $7 from him, but I don't know that for sure. Pretty senseless, either way.
