Uncertain Employment Status

    Okay in October my fleet owners retired a bunch of trucks including mine for high mileage. Mine was up to 1.4 million miles. I turned in my truck Oct. 31st and I've never been reassigned a new truck. I'm not sure what is going on with this place.

    I did get a candid comment from them saying they didn't consider me a very profitable driver which is hard to argue with. This summer I spent almost 2 months on workers comp after I was blown over and broke my arm. Also I've had bad delays from Reefer breakdowns. Would be nice to get some credit for now having a trailer full of thawed bacon.

    Also the owners wife was #####y to me when I was slow to get going during that big cyclone coming through Chicago. I'm sorry I didn't want to be blown over again. :biggrin_25513:

    But to the point, they have not fired me or laid me off. Basically just being neglectful and not communicating. Should I still consider myself an employee? How long could I keep using my insurance card ? :biggrin_25522:It's in December now and I just refilled my prescription and Walmart still accepted it.

    Anyway I'm not to upset it's really a case of the Boss's Wife not liking me and I've been wanting to get out of there. I have a new job starting soon but wondered if I never see them again should I always consider myself employed there if they've never fired me and I've never formally quit? It's like employment limbo

    Who cares! Just keep using the insurance till they won't accept it anymore or until you get new insurance and then forget about it and move on.

    I think more info is needed! Have you worked since they got rid of your truck in October?
    If you have been fired or terminated they may still have you on their insurance for 6 months to comply with the Cobra laws.

    But cobra laws require them to do it yes. But they do not usually pay the premium.

    Have you been paid anything since they sold your truck out from under you?
    Does your state have partial unemployment benefits?
    Sounds like they want to be rid of you without actually firing you. Pretty crappy way to do someone, sounds like you would be better off with out them.

    if you havent been working in over a month, and they haven't told you to expect work, then yes, it's safe to assume you won't be running loads for them again.

    I don't like the company and I'm happy to leave. I haven't worked for them since October then but I'm do to work for another company after this weekend. I'm not in bad financial trouble so I just had November and Thanksgiving off. Plus collecting a small amount of Unemployment which will cancel soon.


    I guess it's funny trying to explain it to the state unemployment insurance people when they ask if I Quit or if I was Fired. Or when filling out any future job applications. When applying and writing down my job history in the future I might just shrug and say I was basically laid off.

    I do find it amusing the Insurance Card still seems valid and it makes me curious how long I can keep using it. Oh well the new company bennies sound decent so I'll probably drop it but I might actually call the number on the insurance card to see if I'm in good standing and if somehow my dues are being paid.
