    i wanted to know if there was anything i, could do about the money an owner-operator I was driving for owes me, he owes today 12/10/10 and last friday's pay, I, still have the signed bills from the last trip i delivered, it's worth $1000, the owner owes me $700, I wanted to know if anthing i could do with the bills as far as a lien, or factor the bills for myself, thx

    6 years ago I had the same problem almost exactly,here in Mn we can,for a small fee,file a complaint in small claims court,and after I won,I recieved the filing fee back...:biggrin_25525:

    you could try small claims court as mentioned, but i think they might have a dollar limit as to what goes through that court.

    but what i think NEEDS to be said is, "some" o/o's are not very good at handling thier money. i think it would be best you try to recover your money due, and DO NOT work for that o/o any more.....or ANY o/o for that matter. one will NEVER KNOW thier financial situation, whether or not they pay for fuel, taxes, repairs whatever....you COULD BE STUCK some wheres and not have a way to get home........if the o/o suddenly goes out of business....and the fuel card is no good......there are a LOT of POOR o/o's out there these days, and i myself worked for one years ago. so i speak from experience, and i can assure you, i'll never do that again.....

    I took a company to court for over $3,000 owed me. Won the judgement, haven't seen a dime. Can't get blood from a rock.

    gears is correct. I had the same thing happen two years ago. had my former employer owe me $3600.. My own dumb fault for letting it get that high. He flat out told me to prove he owed it to me and take him to court. He even told me to come back to work and he would pay it back over time. I got paid and this is what i did. after 5 months of not being paid I tacked on intrest of $600 and after a stern warning.. I told a guy that if he could get my money out of him I would give him a thousand of it... he didn't have to get real nasty or anything..... just pay a couple of face to face visits with him and his wife and money was paid... I know this is not the perfered way to collect but it was effective..

    This is very true. It is relatively easy to WIN a law suit. But COLLECTING the judgement can be problematical.

    If your driving one of his trucks..... sell everything off the truck you can. Tires, rims, etc. Just say you were robbed.

    Boy that sucks.You can probably win in small claims court but still not get paid.Why won`t the O/O pay?If you`re being fed a B/S story then I wouldn`t wait on court.Try calling when you know they are asleep.You may have to do this several times but it worked for me after 3 calls on different nights.Just tell them you are unable to sleep because you are worried about your finances and since they owe you they should be awake too.
