No. I am a paramedic and very familiar with HIPAA laws.
They have the right to the form and use the form to verify any and all prescriptions found in the vehicle.
I am not going to argue the point.
You have been told they have required the form.
You were not there nor have you inquired as to the states.

Obviously you are not THAT familar with HIPPA.... The driver is not required to carry the long form. And they ARE protected under HIPPA. Maybe you should take the week long classes that cover HIPPA from top to bottom? Until you do, you just need to worry about basic patient confidentiality.....

I will not argue the point.
You are not the expert on this and it has been requested.
I suggest you become more familiar with the various laws in addition to what you think you know. There is no violation of the HIPAA laws. Otherwise, there would be a violation for providing them to the employer. It is the same thing.
I have been a paramedic longer than you think. -
Again you are confused.... I would suggest you cite FMCSR Regs.Last edited by a moderator: Dec 24, 2010

Personal attacks, name calling and such are against rules.
I have never STATED THAT THEY WERE FMCSA.
I said they were STATE LAWS.Last edited by a moderator: Dec 24, 2010

Second cite State law....
Third... If the employee does not give permission for his/her medical info to be disclosed.... It cannot be disclosed, what part of that do you not understand ?????

I will write this one time.
I was asked for it by some states during level 1.
The company I am leased with required the medical long form to be submitted. There is no other alternative acceptable until my state joins the CDLIS.
I am finished with you and your ignorance.Last edited by a moderator: Dec 24, 2010

Page 3 of of my Indiana CDL Drivers booklet states I must provide a copy of my completed DOT physical form which they will then use that to track medical histories. This is while getting my CDL permit. So they are getting that information HIPPA or no HIPPA.
Is it a big deal to keep a copy with you just in case?
