yea right. enjoy that obama care.
some companies dropped health insurance altogether.
i got it and the next company im talking to has it too.
instead of filing a suit maybe you can find better job instead of waiting on obama

The federal regs state that you can only drive to a location to get a tire changed if it's SAFE to do so. A flat tire is not safe, and it is indeed, an OOS violation, in which the driver is responsible for. If a driver were to do that, and was involved in an accident, the driver would be at fault automatically. It isn't worth it to break the regs to kiss ### to the cheap and illegal mandate, by any trucking carrier. The same with the HOS regs. Either way, the driver will be hung out to dry and liable.

I had a friend that routinely broke the HOS regs for his carrier, "just to get the loads there on time". One night, west of Dallas, he got pulled over for a routine traffic stop.
He was over on his 14 hour rule. He was arrested and incurred a $4,000 fine.
His company stated that they did not compel him to do this. They ALWAYS will deny that they told the driver to go over his hours. It's just not worth it.
Run legal and you won't have to look over your shoulder. It's the RIGHT thing to do!

I totally agree!! You the driver has the utmost authority operating that truck not the dispatcher. Whether is weather, hrs of svc etc if for any reason you don't feel safe or your running out of hours park the truck!! The driver is not the only one that has to abide by federal hos regs, the company has to also! No ifs ands or buts about it!

That's kind of a stiff penalty. The time I got caught going over my 14 in LA. They had me drive 16 miles to the nearest truck stop and shut me down for 10 hours. Then I got a $150 fine in the mail.

The companies can deny all they want now. All OOS go on their CSA2010 reports. So now they have to be responsible in how they force their drivers.

My deal I was sick with later turned out to be pnuemonia in one lung. I pleaded with dispatch to get me a relay. They said there was none and ignored me. I was under a Tyson load and our company gets fined $400 if the load is late and they turn around and take it out of the drivers pay. I had to take extra naps but in my mind I was still safe. I was 45 minutes past the 14 and 25 miles from delivery. So I was in a position get fined $400 by the company or $150 by DOT. Next time it's screw the company.

I know what you mean! The carriers do have an advantage though. They seem to get away with lies by denying everything. That's why "I just say NO" to illegal BS. It seems as though sometimes we are danged if we do, and danged if we don't.

When I can afford it, I would like to become an owner/operator. I went to school for freight broker, which qualifies me to get my own authority. Now, if I could only come up with the $$. At least as an O/O, with my own authority, I wouldn't have to put up with alot of the BS.

The fines you get depend on the jurisdiction you are in. Some place are more some places are less!

Don't scare the drivers. You don't get arrested for busting your 14. The guy if he got arrested had something else going on like a warrant, suspended license or drugs.

You would get a big fat ticket & be shut down for 10hrs. The exception to that is if the driver cause an injury accident or is under the influence.
