depends on how the cop writes it up. Overweight was no license points but "misuse of a vehicle" was points.

i'm sure there some that would though cause there having a bad day -
One reason to fuel before loading!
If the load is over 32,000 I scale no matter what!
If it's over on gross or axle it WILL be fixed or I do NOT haul it!
I've gone the "OH YEAH, run with it and we'll okay it" only to get stopped, ticketed, give the ticket to the company, get stopped several months later, spend the weekend in jail because it was "overlooked" and not paid and my name was on the stupid thing and pay the ticket out of pocket when the judge gets to work Monday morning, then head back to the yard and put dispatcher up against the wall for leaving my arse in jail all weekend and then get to go back to jail for assault on a moron! Glad the owner got smart and paid that bail and had the dispatcher drop the charges or get fired!
DO NOT FALL FOR THE "WE'LL PAY THE FINE" unless you get it on Qualcomm or by fax in writing!
It's on the truck you're driving, so it's your responsibility, not a dispatchers. His job is to call the shipper and tell them it's not legal and to either fix it or remove it from the trailer. If he can't or refuses to do his simple job then because I have the whiskers in this business I'll park until someone pulls it out as I'm not anyones patsy!
A NOTE: If you get an equipment violation of any kind on equipment owned by a company and your name is on it DO NOT TRUST ANYONE TO PAY IT! If they insist on paying it you stand there and watch them make the call, write the check, put it in an envelope and then YOU take it to the nearest US Postal Service mail box or office and PAY for return receipt requested on that letter! This is a CYA item! If it's not paid they will NOT put a bench warrant out for XYZ Trucking but Joe Blow whose name is so prominently printed on the ticket with Joe Blows signature at the bottom!
My little jail time then was in an old school jail house where a little old lady cooked the food, you had the cell to your self and it was actually better than some motels I've stayed in ! BUT there are other jails that they will cut your hair, attempt to knock your front teeth out and orange is the color of the day! Just because a moron dispatcher or owner told you to run with it! Not in this century ever again! -
Also depends on if your an O/O or a company driver. I don't personally care what the load weighs, I care what it pays. If it's overweight but they're willing to pay more and it doesn't send me out of my way (bypassing scales ect.) I'll take it. If your a company driver and won't make a dime more it's totally up to you. Also since every trailer we own is air ride and have pressure gauges, I know what it weighs as it's being loaded. I've only used truck stop scales once, ever.
