Well if you want to put something on his DAC report you have to pay to use the service and it's called hire right I do believe....google dac and you should be able to get all the info you need.
but seriously you should find out the full story from BOTH parties before you go to court
and remember that if you do go to court everything your company does better be above reproach.
If your dispatchers were making your drivers run illegal then your drivers can get you in a world of hurt with the DOT........just telling it like it is

With only hearing ONE side of the Story, I would say that if you are the owner of the company Maybe you need to take a visit to the driver First. Then you need to see what you as a Company Owner can due to make the Situation Better. And Depending On what State you are in YOU Might Find yourself Not only Paying Him for the Mileage OUT and BACK you cold find yourself in Court for Holding HIS Check, Most States Have laws that State when an Employee quits or is Terminated That as An Employer You have 3 Business days to pay them. Check with your Attorney and pray about anything you do Make sure your decision is something you would not want DONE to you. KARMA is a real deal, and IF you do not think the word on the street about HOW you operate will not effect you well go ahead and try to Get the small amount of Money for the 500 something MILES you Said this Guy went out and Back, a couple Hundred dollars is a learning experience and a write off on your taxes, Be glad he did not leave your truck in BFE with NO way to find it, He did you a Favor by bringing it back to your YARD which By Law he has Returned your Equipment to you regardless of Loss of monies to bring it back. If Your Employee is smart and Hires an attorney You could Lose your bass on this one, If your were my Former Employer I would win in a court of Law, as you are going after the wrong thing FUEL Cost.
You Should be looking at Out of ROUTE miles, Cost to get the load their ON TIME, and any LATE Charges from the Customer, Any and ALL Office Expenses related to this.scottied67, PurpleKW and rocknroll nik Thank this. -

he did say the driver turned his cell phone off . so how is he going to get his side ? maybe the driver should have talked to the owner before quitting. I dont know the whole story either just saying

As the "owner of the company"...why are you here asking other drivers what you should do? Don't you have legal counsel or aren't you associated with your State's Employment Department?
Why people come on this forum to get legal advice doesn't make any sense...why not just get on down to the closest truck stop and check with the coffee clutch drivers at the counter....they always have all the advice and experience to assist anyone!

If the driver filed an application with the company, as opposed to being picked up in a Home Depot parking lot, then this employer knows his address. If I were this employer, and Thank God I'm not, at the very least I'd have the patience and fortitude to visit this driver and get that side of the story, instead of automatically swallowing the lies of some dispatch dirtbag, and subsequently attempting to sabotage that driver's career. My question still stands: what's the name of this outfit? Just wanna make sure I never step in it while I'm looking the other way...

If the details of the OP are accurate, I don't see where the driver would be liable for anything.
It is the right of any employee to quit any time he wants to. Granted he can't just abandon the truck anywhere he wants to.
He didn't abandon the truck. Although he was under load, he still brought it back to the company terminal.
Look how many drivers get "abandoned" by their company. If fired on the road, the driver has to clean out the truck and pay his own way home.rocknroll nik and keepntruckin Thank this. -
Like others have said, look into what happened.
You are losing some money. BIG DEAL! All companies lose money at one point or the other. But I guarantee you that your income is not stopping. Your profit is not stopping. Yall had to do something to this driver to get him so upset. So he chose to terminate his employment. Was he in the wrong? If he didn't deliver the load and just abandoned the load entirely without communicating with yall, then yes he is in the wrong. Tell it to DAC.
But to sue him? Sue him for what? He likely does not have much money. Especially now that he terminated his income. But you...like other greedy people are looking to screw a little man.
He screwed you, reported to DAC. But if you are looking to double screw him by sueing him, you have no integrity what so ever.
And how dumb are you to ask DRIVERS on how to take care of your situation? Didn't you get the memo that we stand up for eachother? You cant be that dumb.....just sayin...rocknroll nik, keepntruckin and walstib Thank this. -
