I don't care how mad you get, you don't quit under load, and you don't drive out of route. If the company told him not to drive home, it could be a criminal matter. But with the cell phone off, I doubt that happened. That's unauthorized use of equipment either way. He should of parked it right where he was at and found other transportation home. Let me guess, you didn't get him home for Christmas?
Every one of us got mad and wanted to quit at one time or another. There's a right way and a wrong way to doing it. Even if that driver had a justifiable excuse to quit, the manner he done it was wrong.
Suing him is up to you. It's a business decision. Yes, you would win. But you have to file in the state he lives in. Then you have to worry about collecting from an unemployed person. Is it all worth that? Personally, I wouldn't sue someone unless it was in the thousands. Write it off your taxes and learn from the situation. A good dispatcher knows how to calm a driver down instead of adding fuel to the fire. Take a look at your dispatchers attitude.

seriously am very curious to hear what you have to say about your dispatcher and what the drivers story is. theres more to this story then just a mad truck driver. people dont do things like that for no reason with out being provoked. i'm not making any excuses for what he did and he sure as hell should lose his job, but you might wanna find out what actually happened because if its a dispatch problem, then its gonna happen again and again and thats not how you run a business.
but you'll do what you want, sounds like you dont give a crap though just interested on how to screw this guy for anything you can get which really says something about yourself. however feel free to change my mind.PurpleKW Thanks this. -

It all boils down to whatever contracts (if any) were signed upon hiring this driver.
Not the kind of question an established business owner would need to ask on a public forum, no real legal advice will be found here - just opinions. -
You can only suit him for whatever he contractually is obligated to, you need only read the employment agreement you have with him, if it doesn't specify what you can seek for damages, you can't...If ti doesn't say you can recoop those costs, redo your agreement for the next time and live and learn...Why not talk to the driver, maybe someone at the company(i.e. dispatch, etc) caused this blowup and you're ignoring the elephant in the room?...Is he someone you want to keep or is he just another body to you?...Don't be so quick to try and be vindictive before you know all the facts, you're a boss and are suppose to be the level headed one not someone that hastily responds because you're pissed your out fuel money...

The smaller the company, the more likely an owner is to dig to the root of the problem... if a dispatcher is the cause of this trouble, I'd drop-kick that p.o.s. as if I were starring in the NFL, otherwise he'll surely cost you more in the long run. In this economic climate, companies try to downplay the importance and value of good, reliable, experienced drivers... this bad economy won't last forever, and you'll soon learn the relative value of a driver and a dispatcher, I guarantee it. Unless, of course, your company has already tanked... enough said, I'm back to the ballgame...
