What are your feelings on that? I have 15 ind cont that work for me. They like owning their own truck, and making more money than a company driver. The current system works well for both of us. If they change the classification, I am afraid I will lose these contractors.

Where did they get the trucks?

If from your company it might be at risk.

However, in the many discussions that we have had the last many months, your company is not one that I feel is in the position of abuse of the program. The actual dollars involved to your lease drivers is a major difference from say the mills like CRE, for example.

I feel they will look at the programs and begin to analyze them. If the lease owners are a productive lot, which most likely they are in your situation, then not much scrutiny.

Do not worry, this will not happen overnight. There are many situations in this industry that they will look at first.

Many OO pay their drivers as 1099 to avoid employee situations and cost. These will fall first.

Currently, we have no ind cont that purchased trucks from us. We are in no way involved with the financing of their trucks. They receive the % of revenue stated in their contract. About the only thing they purchase through us on a regular basis is fuel.

I was right about one thing...great year for open deck. We should see a record year for both our company and our contractors. Although demand has not fully rebounded, supply it still extremely tight. In my opinion, it is a great time to be in the open deck side of trucking.
