Good news!! I just got a phone call. Decision was reversed based on the sleep apnea and back after they received statements from the RT and orthopedic doctor. A check is being mailed today.
But I'm not getting the full amount. They only pay 60% of your income up to $350. I clearly made enough for that. But the per diem thing is not considered income. I contested that was money earned and not given to me. It's just untaxable money. Doesn't matter. Truckers are taken advantage of. What's on the W-2 is what you earn. I guess I make .22/mile instead of .38/mile. My fight is finally over. Thank you lord. I'll take it. I get $319/wk back pay to Oct 29. Feb 1, I automatically rollover to the long term policy and it's a little more.
Another good thing is they pay 5% more incentive to go to therapy. They also pay for other certain medical care to get you back to work. I can see light at the end of tunnel once again!

Glad to see that Condo! And just as an aside here, looks like just ONE MORE reason to forgo that "wonderful per diem."

What company pays $.16/mile per diem? As an OTR driver at 600 miles a day that $96/day per diem. IRS limits itemized deduction of only $57/$58 (can't recall which right now). Something doesn't sound right.

I just threw a number off the top of my head. 2009 pay was $27K and perdiem was $16K. What ever that works out to.
They aren't paying anything really. Those are normal wages made tax free.
If someone doesn't claim per diem, then they would get the full benefit and then claim the deduction on their taxes. That $16K doesn't show up anywhere on the W-2. So I'm not sure how or if it gets reported?? You live and learn. Next job, I'm opting for no per diem if I can. It would be in a drivers best interest to wait and claim it at tax time.
I'm not sure what's going on with the insurance company now. They owe me 12 weeks back pay. I got half the other day and when I asked the insurance lady, she said I would get the rest of it when the investigation is complete. I said you already told me I was approved? She said I was approved for the 6 weeks disbursement. So I'm not locked in yet. I got two things disqualifying me from driving. One is considered a pre-existing condition by one day because my employer secretly changed insurance companies. The other is not.
I been feeling bad the past couple weeks. My blood sugar been hanging around 230-250 too much. I have a feeling I'll be going to insulin the next doctor visit. -

oh man, that sucks about the insulin part. Im a type 1 on an insulin pump and i know all about blood sugar probs i found out the hard way ehn i went into a diabetic coma. But im gald to hear u got some good news out of it ands they are attempting to get it all ceared up and reimbursing u. Keep me informed on teh whole insulin thing if u ever gots ? let me know. Ive been on insulin 11 years nowand have done the diet, carb counting, pills, shots, and now an insulin pump that makes my life so much easier and most insurance companies cover up to 80 to 90% of.
