I'm writing this to complain about R & W Transportation Inc. (US-DOT # 1748828 MC # 640249) of Austell, GA, and it's owner Yildiz Warren.
She puts drivers under extreme duress, fearful for their jobs, and pay earned.
She routinely keeps drivers pay by holding back a week and terminating their employment on payday with out paying them. In December 2010 alone, she hired and fired 3 drivers, while only owning 2 trucks. She'll penalize drivers for missing appointments, not able to be kept when following FMCSA hours of service, by deducting funds from their pay.
It is expected for drivers to operate her trucks, as independent contractors, despite the facts that she picks the loads, lays out the route, refueling locations, prohibits unscheduled stops, etcetera. She does this to clearly avoid paying Unemployment Insurance, Social Security, etcetera.
Drivers are expected to operate beyond legal hours of service, by falsifying their logs. The 60/70 hour rule is routinely violated, as she feels a few hour break is following the spirit of the law. For example, weekly, individual drivers are expected to complete a trip from Marietta, GA to East Granby, CT (1025 miles in 18 hours) described by the broker as a mandatory team load.
Frequently the loads required for the driver to haul are overweight, and drivers are expected to drive around the known scale house locations. If scale locations are unknown, unreasonable to drive around, or unexpectedly open, drivers are expected to simply drive past with out stopping.
Safety equipment is deficient. Safety belts are broken. Marker Light wiring is damaged, causing many lights not to operate. ABS on both trucks and trailers are not working. Over pressure valves have been replaced with plugs.
She is well aware of upcoming DOT audits, and brags about her ability to come out of these audits unscathed.

If it were that bad Id not have stayed more than a day got an advance brought the truck in and said my goodbyes.

My previous post is actually the first draft of a letter I plan on sending to various agencies. Only I'm not sure where to send it yet.
Honestly, I was willing to put up with everything, so long as I was getting paid.
I kept asking myself, "Why stand up for the other drivers, so long as she's not messing with me?" I should've! I'm now owed $3620.

and also if you have an emplorer that wont pay you you can also take the truck to your local leo and park it there they will get you to sign a lean on it and it will be held till you are paid i personally checked on this here and found this to be true.

Fallinangel: I wish I had known that I had the ability to place a lean on her truck. My week off was due to start Saturday. I knew Friday, when no deposit had been made to my bank account, that she had no intention on paying me. So, Saturday, when I was due to turn in my bills ($5,200 worth), I kept them. I've had several threating calls from brokers.
I intend to send it to Georgia Department of Public Safety - Motor Carrier Compliance Division, Georgia Department of Labor, Georgia Department of Revenue, US IRS, US Federal Motor Carrier Safety Administration, and others. Just as soon as I can find email addresses, fax numbers, or (worse yet) snail mail addresses. -
