Looks to me the UPS driver wasn't paying attention and SLAMMED into the dump truck !!!!!!

One thing that's really sad about this, if the two in the dump truck had been wearing their seat belts they very well might have survived this accident. Obviously there is no way to know that for sure, but IMO it would have helped.
I personally wouldn't be to quick to judge the UPS driver, I have seen way to many dump trucks driving around with lights so dirty they can't be seen, or they don't work at all. Most of the dump trucks I see around here are in VERY POOR condition. -
Yeah thats true about the seatbelts. You'd think everyone now knows the importance of the seatbelt and that we all NEED to wear them EVERYTIME!

The thing about the tail lights not working is, how do you prove it? More than likely you can't unless the UPS driver had video in his truck, which i doubt.
Then there's the speed issue. Was the UPS driver going too fast for conditions? Is there a minimum speed on that road? (probably not)
I sure would love to get a video camera on my dash for this very reason! -
When lights are burning and they are blown because of impact, it is easy for investigators to tell. The element fries in a specific way. If the lights weren't on at all and were cool at impact, it is easy to tell there too, because the elements break rather than melt. They can tell if the lights were burned out before impact from the age of the damage.

Speed Limit 65, weather was clear, good visability. There is a pit/mine right there, so the dump truck may have been going very slow.
The road coming out of that pit/mine is a dust bowl, even though it's wet down numerous times a day.
I understand the UPS driver WAS ticketed,
but haven't been able to verify that yet. -
What do you think he should have done, parked on the side of the road until morning? That would have been an accident waiting to happen.

Not left when he did his pre trip inspection and found the lights not working.

If he just came out of that mine/pit, there is plenty of room to stop and check or
clean the lights.........
