    I agree with getting someone to sign before leaving a customer like that. Sometimes u p/u someplace and the only way to a scale is going through a scale house, so that would most likely be the only way you could get out of it. I've seen that happen before.

    I got an over-axle once years ago, or I should say the company did. Load could not be balanced (even with 6 weighs and reweighs and the help of a more experienced driver). Qual comm message to the company that I could not balance the load. They sent back a message to run with it. Showed that to the scale cop, and he gave them the ticket. That was in Maryland back in 1999 though.

    Not that I'm an attorney, but I'd think that dispatch directing you to run a load that is illegally overweight - especially with the smoking gun of a QC message - is a violation of the federal Surface Transportion Act.

    Probably was. I'm not a lawyer either. It night dispatch, so who knows who was in there. I just figured I was gonna have it in writing so it would be known.

    That's the reason why I loved Qualcomm! They send you a message with stupid orders like run with it AFTER you tell them it's over weight by such and such and need to go back and get it reloaded then that information sets on QC's servers for about 6 months so you can get it if you need to take said company to court to recoup your money!

    That advice from 2 years ago about keeping after a company if they "say" they'll pay a fine is still good information which I have advocated for many years after a wonderful weekend vacation in Georgetown, Ky's jail for a non paid ticket!
    NEVER hand over a ticket until you have a copy of it and then it's still your responsibility to make sure it's paid! You talk to payroll or your safety people every day by phone and with messages about the status of the ticket. Then after a week but before the ticket is due at the court you need to be calling them every day and checking about the status and if it hasn't been paid then you have the copy it's in your best interests to pay the ticket ASAP using FedX or overnight USPS and then confront your company about the ticket on the load they "told you to run with!"

    But trust me on this. The old style jails are gone and GP and nasty food is now the standard and that old jail in Georgetown with the little old lady cook ain't there! Sitting in a jail waiting for your company to get to work so you can get an advance on your pay to pay a ticket or for your bank to open (this was back in 93) so you could draw money out isn't fun!

    This is also a good reason to have that emergency credit card in your wallet. Every court and jail has access to an ATM so you can pay a fine or bail. That's all it's used for except for either a bus ticket or flight home. \

    But NEVER trust anyone with a thing that can get your arse thrown into a jail or add something to a "record" that's in your name and not theirs! I have yet to see a whole company dragged to a jail because they said they would pay a ticket or failed to pay an over weight fine! You get to have all that fun! This is a great reason that doing what you should be doing instead of letting an armchair driver tell you what to do! You aren't going to wake up in jail with that dispatcher in the other bunk are you? Screw them and go get the load fixed and if it leads to getting fired you'll have a copy of the scale ticket to send to DAC with your rebuttal form as proof!

    Good point, but it is always the driver that is responsible for the rig he/she is driving. My company always sends out the helicopter with lumpers to move my load, I thought all companies did that!:biggrin_25520:
