O/O Passenger Laws

    Apparently you are not familiar with the actual employee law.

    You are required to wear a uniform are you not?

    They tell you when to work do they not?

    They set the rate for you do they not?

    They tell you when you can take time off?

    You can take the truck and go somewhere else to work?

    I do not care what a contractor thinks. Nor do I read any of the stupid stuff you state I did.

    I am only referring to the law.

    Contractors are really nothing but employees even if they are corporations to prevent the FEDEX exposure which is still there.

  3. Uhh...Nope. I wear whatever I want to. I like jeans. I have worn uniforms, because they were given to me free of charge, but usually wear jeans and a T-shirt. I've never been required to wear uniforms.

    Again, nope. I start when I want to, allowing myself enough time to deliver on time. I like to run slow, so I typically start early.


    On some things, but most of the runs that I do are negotiated with the company. One portion of my day includes a run that is payed according to their mileage rate, but I choose to do that run. I could run only runs I've negotiated, if I chose.

    No to this one, too. I take off whenever I want. I didn't run most of last week


    If you are asking if I can quit running for FedEx and go somewhere else, yes. I bought the truck. Traded two horses for it, actually, from an individual. FedEx doesn't offer lease purchases.

    If you are asking whether I can use the truck outside of FedEx. Yes. As long as I cover up FedEx's logos, they have no problem with running under their DOT authority. It's specifies that in the contract and that little tidbit has caused me some headache with the state I get my base plates out of. They don't like that. I often do run loads for friends of mine who have their own authority.

  5. Not really. There are more of us around than you think, but we're the ones who've been here longer and have seen the things FedEx tries to pull off. FedEx will certainly run your truck for you if you let them, and it won't be with you're pocketbook at the front of their minds. Ask those guys you've talked to if they've ever actually READ the contract. About 99% of the guys I talk to never have, and wouldn't have any clue where to find the things I was talking about.


    Another thing, too, is that I'm not referring to the P&D side, the guys with the small step vans. I think those guys are hosed on a regular basis. FedEx DOES dictate lots of things to them that I'd NEVER agree to. But then, most of them are driving a piece of $70,000 equipment that is useless anywhere else. They are locked into whatever FedEx says because nobody's going to give them their money back for a truck that can only be used at one place for one thing.
     
  6. I messed up on this one. I should have added that you have to cover up the logos AND you have to cover the loads you've agreed and are contracted to cover.

    So, you have to cover up the logos, AND the work you do outside of the company can't interfere with what you've already agreed to do.

    Its not illegal so to speak it is against the IRS rules which makes it worse. It can't be against the "law" unless congress passes it but it is very illegal in the eyes of the IRS unless you sign a contract.... AND AGREE TO BUY THE TRUCK (legit buying of truck not just on paper). Or she leases it to you and you sign a lease agreement and she give you a power of attorney.
