    Oh If I had decided to turn the truck in and call it quits ya'll would hear about it. Id make an announcement similar to this.

    "Smurfette has decided trucking is not for her. She turned in the keys and hung her head. Stating that all boys in the industry are jerks and should not be trusted. They Lie Cheat and Steal to get their way. She could not live up to that and so without even finishing her year. She will now take the bus ride of shame home and ship all her stuff to various points in the country and ask people to put them as memorial markers along the highways and byways in which she drove. To commemorate her short lived trucker life."

    Sadly I'm still trying to make this job work so you are technically stuck with me until further notice.

    Quote from a police officer I over heard.. "whomever thinks I cannot write-up and cite on private property watch as I write this ticket." I got a 166 dollar fine on private property. if they could not do this then they could not investgate ANY crime committed on private property. Common sense here folks..

    Most of the time only "careless driving" tickets are written on private property if warranted. It's also not a moving violation that would go on your record like one that you might receive on a city street, hwy, or interstate.

    Now if a person is negligent while driving on private property, ie: DWI, DUI, or just plain acting stupid then it's a different story. Usually accident reports are written are done on a short form for an exchange of information for the two parties involved for insurance purposes. Usually city or town ordinances instead of state statutes apply in this situation. So this varies from state to state and city to city.

    There are actually a great many laws that vary from State to State. For example, years ago, when I was a Police Officer in Virginia, I could make a traffic stop on private property. But the only citation that I could write for an offense on private property was reckless driving. The state law would allow me to arrest for DUI even if I only observed the person drive, or operate, on private property. However the accused was not required by law to submit to a blood, or breath test. The BAC test was only required if they were on a street.

    In this case it does sound like the officer was shirking his responsibility to investigate. Whether he filed the report as a hit and run, or destruction of property is really irrelevant. He has the same responsibility to followup.


    Under Virginia law a warrant was needed to charge someone for destruction of private property, if not committed in the arresting officers presence. However an arrest could be made, based on probable cause, but without a warrant for the destruction of commercial, or property owned by a business. I may have even chosen to call this case destruction of property. Then if I caught up with the driver I could have arrested him. That way it would have been up to a magistrate to determine bond before releasing him.

    But, that is just Virginia since that is what I knew. I got long winded, but my point was each State has their own quirks, and each officer can make the quirks work for him, or be lazy and hide behind them.

    I'm also a retired LEO. Yes sometimes guys want to get out of that paper, just lazy. You're right it changes depending on where you are.
