I received my first fine ever and I'm a bit lost. I received a 6 mph over speed limit (71@65). Along with my fine I received a driver examination report which is to be signed by my carrier and sent in by them. I plan to fight the violation in court to keep this off my spotless mvr. I have a good chance of getting this fine removed or brought down to a non moving since my truck is governed at 68 mph and I have a letter from my carrier to certify this true. Now what would happen if I don't turn in the driver examination report. It's the difference between me keeping my job or loosing it. Just started with this company and I'm still in a 90 day probation and was specified that a violation could potentially disqualify me. Thanks in advance to all that read and respond.

you NEED to turn in that report. in due time, the police agency that GAVE IT TO YOU will be calling or sending a letter to the company to find out why they haven't sent it in...which right here i do not understand...how could your company give you a letter stating the truck only does 68 mph, when they haven't even seen this report you speak of..?? are you assuming they will do this for you...??? you should have gotten one copy ,and from there you turn it into your employer.....if i were you, i'd make a photo copy of it as well and keep it......
now, i'll tell you, you most likely got banged with a minimum of a 5 point CSA on your CSA PSP file, multiply that by 3 and you got a whopping 15 points on you RIGHT NOW....that cannot be removed with out a LONG LENGTHY PROCESS.....and even then, there are NO guarantee's it'll be removed..
can you have the speeding fine reduced...?? perhaps, but the speed limit was STILL 65, and if your truck DOES 68, and you DID DO 71, you WILL STILL GET BANGED for doing 68.....as the speed limit was 65....
now too, those CSA POINTS, WILL NOT come off your PSP report..they stay there now for 3 years.....
you newbies/rookies absolutely floor me....once you get into a truck all by yourself, you forget the rules, regulations and laws, then when you break them, you come crying to us about it..
well buck up, you are hit with 15 points now for 3 years, and for speeding now less...to some companies, this will show them a "possible" pattern of your driving......

Well you wont actually have 15 points for 3 years. Assuming no other violations the weighting gets less over time, after 12 months it will only be 10, and after 24 months it will only be 5. But yeah I agree if you were caught for 71 that's probably not good. Did you by chance happen to be coming off a hill? It's fairly easy to pick up speed. Best of luck to ya,but if it was my company and this is your first 90 days I let you go.

Well I appreciate all the advice. I just want to clear up though, ive been driving for 3 years with a SPOTLESS RECORD. I'm only new to this company. Yes I was coming off a hill I was doing 71 I have not denied that I simply implied that I have some things going for me that might help me in court. You see you as a trucker know that i can easily reach well over 68 depending on the grade of a hill and my weight. But does a prosecutor readily know that? He might and might not. I know all about csa in theory, it's just I have never actually ever received so much as a warning in 3 years of otr driving so I think that speaks volumes for my "driving pattern". Anyway I talked to my boss about it and he laughed at a 6 mph over. I am all set. I would like to say that i forgot how some drivers pretend to give advice but are really just sitting in from of a laptop screen in a truck stop just waiting to be a critic instead of helping a fellow driver. "crying to us" I thought there was a diffenrence between asking for advice or crying for help. To all who appreciated my situation I am thankful.

if the speed limit is 65 mph, it'll be 65 mph even going downhill...it is your responsibility to hold it to the speed limit...
good luck though, you still have 15 CSA points, and IF you do get "let go" by this company...?? and another company pulls your PSP....??? good luck trying to get that job......
i'm glad your boss was laughing at the ticket......just wait till he gets some CSA points fro inspections........let's see him "laugh" then..... -
The CSA points only last 2 years. I am looking at my companies CSA page as I type this. An offense is multiplied by 3 for the first 6 months, by 2 for the second 6 months, and is face value for 12 months after that. There are no offenses listed older than 2 years.

71 in a 65.............where does it end............keep it up, next thing ya know they will have us at 55 again....give a guy a inch...........and he want's a ruler...........

There's a gillion reasons why the guy might have gotte stopped for 6 over - maybe his dash was cluttered.
That said, it's easy to do 70, 75, 80 in a truck that's "governed" at 65 or 68... just coast down a hill. Guilt is guilt, unfortunately.
At that 68 mph limit from your company might just burn you - the judge could easily reduce the speed from 71 to 68, but in his/her eyes, you're still speeding when you say "my truck can only go 68". 68 in a 65 is still speeding when you're in front of a judge.
