They do withhold your earnings. We had a guy in August not turn his truck in and he keeps in contact and he said he did not receive his last weeks pay. Maybe they aren't supposed to withhold your paycheck, but they do.

And they are worried about a drivers shortage.bikegoon Thanks this. -
The permission you grant to your employer to report to WHOZIT is a condition of employment. The moment the employment goes away, so does the permission. It is a fundamental principle of AT WILL employment.
The reality is, your employer might have 15 people tasked with the responsibility of "winding up" your employment . . canceling a fuel card, terminating benefits, so on and so forth. The driver has but one person, his or herself and the driver likely has no training or understanding of the law. They allow themselves to be walked all over because they don't know any better. It happens to one and it happens to many and, all of a sudden, it becomes "that's the way it is" . . except to those who know better.
The guy who recovers equipment doesn't know any better. He's only telling you what he's been told and he may well be telling his understanding of the truth. Maybe his company is withholding money from unwitting former employees. That doesn't make it right or legal. If drivers walk away from the beating, so be it. If drivers get a beating and fight it, they win every time. It's just a small matter of understanding what the employer can and cannot do. -
if a company is going to let you go they will get the equipment back to them before letting you go
and if you want to leave READ YOUR AT WILL AGREEMENT you must return all property to the company and they can hold any money you have coming to cover what you do not return
not that difficult to get i don't think any ways
but as for the OP go ahead and leave it some where as said earlier there is a good driver that needs a job so do it it is ok by me

You're correct in your first paragraph, and your second, but I haven't seen a large company yet that didn't require a driver to sign and agreement in orientation that allows the company to recover the costs of equipment recovery.
If you didn't sign an agreement, they can't take the money...but you know they will, and good danged luck getting it back.
By the way, I now work for four lawfirms. I called the main guy I work with and ran this past him - current employee or not, your agreement on the recovery costs stands... period, in any jurisdiction.
Driver: "I want my money back that you took from me for recovering my old truck!"
Company: "Is this your signature on this form?"
Driver: "Yes"
Company: "Have a nice day" -
Geesh companies look for a reason to throw the rod to you, don't make it easy for them.
As somebody else said quit like a man and cover your ###. -
Exactly - call the DM, say "i'm done in two weeks", "this Friday" or whatever, and roll in like a man, give them a truck that's not torn up and scummy inside.. and know you did the right thing AND perpetuated your career, versus career suicide.

I think most of you have been suckered.
-
Nah, good discussion for newbies who might think running from their truck is a viable option.
