misdemeanor charges

    It def. varies based on state because I was orig. from Mass and now in Va. I got a possession drug charge in 07 and Co's. are saying "try back in a year when it's 5 yrs old." I submitted a paper to seal and got it back saying I can after 10 yrs. 10 YRS! Who really cares after that long? I mean don't get me wrong I want it off/ sealed so I don't have to see it anymore but theres got to be something else I can do to make this record sealing possible. And before 2012. Any help is much appreciated.:biggrin_25514:

    I moved from Mass to Va in 2009. Had a possession drug charge in 2007 and 11/2010 I requested my record to be sealed. Not sure at the moment the diff. between sealed & expunged but they sent it back saying the charge had 2 be 10 yrs old!:biggrin_25524: I don't believe that for a second because who gives a crap after that long? Maybe Canada but not most trucking co. Theres gotta be another way cuz i'm licensed and can't get a job. Getting aggrivated!:biggrin_25510: Also veries state to state so...? OOOOps double post sorry

    Yes, definately varies state to state. In California you can have a conviction (misdemeanor/felony) expunged as soon as probation is over.
    Generally expunged doesnt mean it's gone. State DOJ checks and FBI checks will still show the conviction and underneath that it will read that the conviction has been set aside and the case dismissed. You can legally answer "NO" on a job appilcation to the "have you ever been convicted" question.
    7 years after probation is over you can apply for a Cert. of Rehabilitation, if that is granted by a Judge it becomes an automatic application to the Governors office for a pardon. But probation for the offense has to be over for 10 years for the pardon.

    Also to lay other myths to rest, convicted felons can vote. I dont think they can in Florida and maybe some other states, but in most states you can.
    You can't own or be in posession of a gun unless you get a governors pardon. (if your crime involved a gun, you still dont get to own or even hold one)

    An expungment is gone off your record and sealed is not visible to employers etc... but can be seen by police and courts. Can also still be used in future trials.

    It used to be 5 yrs for misd. and 10 for a felony. Now its 10 for misd. and 15 for felony.:biggrin_25513:

    Minor records have diff. laws than adult. You can seal both tho. Also I have read the same about a 1st offense drug charge. Course my "lawyer" faild to mention it so now i'm fighting the courts and writing all kinds of letters to re look at my case and try to get the judge to seal or dismiss my 1st and only charge.     expunged is not "off your record" . It will always be visible to law enforcement and used against you in future trials.

    I had 2 misdemeanors in 94 never had a problem getting a job never been in trouble a day since. watch out trying to go into Canada, I have been to Canada prob 20 plus times. three years ago they did a background on me and turned me away what a nightmare.

    A guy i used to workout with received a misdemeanor federal.
    Hell he served no time and wasn't fined ,but has 2 years probation.
    He never had so much as a parking ticket .
    He was involved in a internet growth hormone bizz.
    He probation officer told him that it wouldn't keep him from any job.
    His first visit from the FDA was in 2007 a year after he quit the bizz but they had his mom motherinlaw sister as well as wife and him sending large amounts of cash to China.
    So 3.5 years they made a a plea agreement ,no jail ,fine ,just two years probation.
    Hell he only has to send in a paper 1 time a month.


    Would this keep him from working anywhere or even maybe trucking cause i have seen some companies just have policys with the norm ,feloney dui etc.

    I told him if they didn't have anything on him to deny everything cause they wanted this deal bad and even the agent said he was a good guy.
    But didn't want his family to get into trouble and admited it,and besides he was ratted out (i think)
    (LOL) This is the same stuff Rambo is takeing at 60 and has 6 pack abs(lol)

    I was hoping to go to CDL school and wanted to ask you all a question before I spent the money. I have a 2 year old possession of parapheneilla misdemeanor charge. Would I be able to get a job with that? My spelling stinks so please bear with me. I live in Nevada if that matters.
