In the best of worlds you are correct. Even in a few places in the real world. But in most places in the real world there are politics that rear their ugly head in law enforcement.
What would pass with just hard feelings in some areas, ie: writing the police chief's daughter for illegal riding of atv on public streets, writing the wife of one of the judges for a minor speeding infraction, could well be a "career ending move" in some places. It is unfortunate, but it is the truth.

As to Injun's original post, you really DON'T know what was going on there. Sure, it looks like this guy was out of his jurisdiction, and was picking on big trucks.
But there well may have been something going on that was NOT so obvious. He also may have dual jurisdiction as both a town cop, and a county deputy.

That's what always cracks me up about the Drug Task Force guys here. These guys on the cb all blabbing about "don't worry about them they are out of their jurisdiction"!
If they only knew, they have jurisdiction in the whole state and can even cross the OH state line and have jurisdiction if they are in pursuit of what they believe to be a FEDERAL crime such as drug trafficking.

Don't get me wrong--I am all for stopping the dope and all the problems that come with it!! Including the stuff some of these dope runners can/do pull--and since you are from the area--that includes that nice little young Ohio stae patrolwoman who got shot in the neck (just above the neck) in western oh couple years back(and thank goodness she came thru it ok)
What i am trying to ssay(and probably not too well) is these locals argument for getting Federal homeland security money for this--I know the money has to come from somewhere--but the argument these gentleman(sic) gave me was that the drug cartels in mexico etc. use their profits to fund al-qaida and terrorism--that's what i don't believe or buy into--as the hispanic comic put it(can't remember his name but funny s hell!)when he commented on it--something to the effect of if you wanna really see a war on terrorism--let the drug lords find out the taliban is trying to compete with them!

'olhand, there is a lot to what you are saying here. However is using "Homeland Security" funding such a wrong move? I don't think so, and here is some reasons why.
The drug cartels are moving big time into the US. They are funding and manning major growing operations in many of the so called "wilderness areas," in our country.
And there are just too many cases of the "innocent hiker/hunter/fisherman," wandering into their grow, without even having the foggiest notion of what they are seeing. It is a very good scenario for a tragic situation. So in a way, it IS a sort of terrorism.
I am aware of things around me, whether I'm on the freeway, in a city, or in the wilderness. But I sure don't want to see one of my grandkids shot when they happen to wander into the "wrong place at the wrong time," if they are out backpacking.
As I have said many times, the drug laws NEED TO BE CHANGED. However this is probably not the time, place or forum to discuss this. . .outerspacehillbilly, 'olhand and Injun Thank this. -
Roanoke County, Va. now has local police doing truck inspections. One of the gimmicks used in Va. is the locality will adopt the state or federal regs as 'local' ordinances. The local police will then write you under the 'local' ordinance, thereby keeping the money local. Sometimes this is good if the local fine is less. I blew a brake chamber. The State Trooper said since I didn't give him a hard time, he'd write me under state instead of fed regs. Wasn't cheap but saved my boss $150.

You also bring up some very good points--and yes the way you lay it out it is a very good case for homeland security money--just like frankly it is probably true about the (for lack of a better term) "Dope Cops" as I like to refer to them--
Frankly the statement I made about Homeland security money had more to do with my Buford T Justice buddy in Indiana--lecturing me on how the drug cartels are funding the Taliban--and blah blah blah--and I think you know(after many of my other posts)how I feel about law enforcement(including DOT)in general--but to hear this rubbish being laid on thicker and thicker by this obvious F4 wannabe--just really annoyed me--so I guess that was really what my comments were aimed at--more the so called reasoning this man was offering
So yes to clarify I am all for doing whatever we can to protect our borders and our citizens--but please officer don't p**s down my back and tell me it's raining!

It's not a gimmick. Each State must adopt the federal regulations as State law. For instance, I can not write up federal regulations. I write up State regulations. The State adopts the federal regulation as State law. The "local laws" I imagine you are referring to is 392.2, Driver fail to obey all laws, whether Federal, State, or local laws or ordinances. In essence anything a driver can violate can be written under 392.2. Whether it is speed, following to close, traffic control device, on the inspection report it is writen as 392.2. The inspection program now has sections such as 392.2S for speeding, 392.2FC for following to close etc.outerspacehillbilly Thanks this. -

If it ain't me getting pulled over, I don't give a #### who the officer pulls over. As far as I know, the truck could have committed a hit & run and every cop in a 300 mile radius was looking for him.outerspacehillbilly and ironpony Thank this. -
That's why you don't want to be pushing 1 or 2 mph over the speed limit in any of these little 'burgs. You're just another cop's payday.
