I don't think it matters whether the OS load was legal.

The driver rear ended a pilot car. Aren't those the cars with lights and reflective signs all over them?

Anyone who drives into something is wrong in some way. (unless maybe it was parked in the middle of the road and covered by a black sheet)

Maybe he was being overtaken by another semi and herded into the OS, but it does appear that the OS was out of the lanes of traffic.

The only oversize loads in Colorado that can run # night are overlength and they must have a flashing beacon light on the end of the load or they can't run. The normal hrs for over size in Colorado are 30min before to 30min after sunset.

"a tractor trailer carrying an oversized load was parked on the shoulder of the highway along with the safety vehicle that is required to follow it"

Don't know what was happening with the shoulder, but the oversize wasn't on the actual road. The other truck had to swerve onto the shoulder to hit them.

If I am reading the news report properly--his permit was for Daylight hours only--so IMHO it doesn't matter if(as has been posted)certain types of OS are permitted # nite in Colorado--this permit was for Daytime--which still begs the question why wasn't this load parked some where safely until daylite?? Why was it out there--shoulder or not--after dark?
This IMHO does not exonerate someone who hit this vehicle--just another part of the puzzle?

well i am sure ya'll are gonna get mad, but oh well....I AM SORRY THAT ANYONE GOT HURT AND MAY DIE FIRST OFF...BUTTTT you guys are all over the oversized load saying its his fault...LOOK AT THE PICTURES...he appears to be on the shoulder with an escort.( with lights going and flags etc...and so did the oversize load....).and so was the HVH driver ON THE SHOULDER...the oversize DIDNT HIT ANYONE...the HVH driver did...I understand about not running except during daylight etc. but how does that change the fact that the other driver hit a truck ON THE SHOULDER?????

I used to haul O.S. out of Colorado Springs. My guess is he was on the road too early for his permit. Southbound out of Castle Rock on I-25 he was gonna hit the scale at the bottom of monument hill after several miles and those guys are a bunch of pricks, so they pulled off onto the shoulder to wait for daylight.
