BAC and driving

    The bottom line is even with a BAC that is legal to be behind the wheel - if you are in an injury or fatality accident, the attorneys for the plaintiff are going to nail you to the wall using your tender parts. And they will win. There isn't a jury in this country that won't help them put the screws to a trucker - and they will do as much damage to your financial life as is possible. If they can legally take everything you have, they will.

    Belly, how old are you? Have you NEVER read about any accident where alcohol was an issue? And it's not just with trucks. It happens with cars also.

    The thing you aren't catching here is this:
    You are talking TRUCKS here.
    Trucks are ambulance chaser targets and the world is a target rich environment for them!

    All you have to do in a truck is BUMP a 4 wheeler or even another truck and the lawyers come out of the freaking woodwork!

    You even smell like alcohol and you're a freaking drunk as he will say in his opening statement! You're a trucker and you're guilty until proven guilty! We have NO rights in the world as it's been proven for many years and is being proven even today!

    You keep thinking what you want to then go ahead and drink that stupid beer then "LATER THAT DAY" go drive that truck and your arse can become some lawnmower lawyers grass!

    From this last remark you DO NOT need to be in a truck! You sir sound like you have a problem and need to address it before you become the very person that this thread has revolved around. The guy that had a TINY percentage of alcohol on his breath and the lawyers fell on him like a ton of bricks! It's happened before and it #### sure will happen again! It's one of reasons that the NATSA for the longest time quit selling beer in their members stores!

    Those lawyers can sue ANYONE they want to! The LAW says they can and it's the insurance companies who get hit first and yes they will get something out of it as mine and everyone elses rates say they do because it's things like this that make our costs go up among the other things!

    You asked but you for some reason seem to want to hear a different outcome but there is no other way to put it. FMCSA has their "rules" on alcohol. We only pointed at 3 of them. Go grab the FMCSA book or look it up online and read the whole thing without looking between the lines! Those rules should be read but not try to read between the lines to get your idea as to what you think they said then try to pass that off on a judge and jury!

    Again if a beer is that important to you please go back to wherever you came form as this isn't the job for you!

    If you have children go look at them and then ask yourself if you would want some idiot behind the wheel of ANYTHING that drank a beer then "later drove on the road?"

    And trust me if it were to happen to any of my family I'd be pushing MY lawyer to not only get many millions of dollars from the company, and the insurance company but everything the driver who just HAD to have a single "beverage" before he turned the key, owned or his life so miserable they'll rue the day they just had to have that beer!!

    Yes, I'm a hard case but many posts ago I gave a good reason why I do not like DUI's, or anyone who even drives buzzed! And 1 is buzzed! IDC what the rules and laws or some stupid body weight chart says! I'm NOT against drinking and having a good time I just have a thing about people who think drinking and having a good time behind the wheel of a car or truck is a good time or anywhere close to smart!

    I'm sorry, but not a single one of us can justify having a drink 10 hours minimum before turning the key to that truck.

    im 28 years of age from san antonio,tx and i have several friends who work as criminal defense and injury case defense attorneys. I been around and you dont make any sense to me at all! Age doesnt matter. As long as your not violating anything on any such penal code then nothing can be done to the driver as long as the company has a zero tolerance policy for alcohol then the poor ******* would probaly lose his job.Yes I am talking TRUCKS,SEMIS,18 WHEELERS,TRACTOR TRAILERS,SAME THING and i never said anything about 4 wheelers did i ? I already found out my info now how do i delete this thread?

    Bellydumper, I am forced to agree with Rollover the Original, perhaps you should be more concerned about why the .04 limit is so important. If I remember correctly, and I may not, .04 would equate to approximately 1/2 of a beer. If I had to worry about such a small amount and the time frame in which it would be out of my system enough for me to drive, I just wouldn't do it.

    Oh, and yes, Rollover the Original was very correct when he stated the legal system is canted against us drivers. I was involved in a fatal accident where the other driver fell asleep and hit me head on. After nearly 9 months of physical therapy and almost a year out of work, I walked away with a measly 12k which was no where near to the amount of income lost. If I had been the one to have caused the accident, I would have lost everything I owned and would ever own, not to mention how much the insurance would have had to pay.

    Now, after reading this, is .04 really worth it? NO, it's not.

    1/2 BEER? 0.04?. I have a friend who is a cop and i used his breathalyzer at a party for kicks and i drank 4 beers and i was 0.05! hahaha. I have child support payments to pay and escalade payments. Im not going to lose my peace of mind and go crazy cause I cant unwind.Ugh

    1/2 beer doesn't even register in a 180-200 lb guy until at least an hour, and in an hour and a half, it's gone.
