No Gman, not a fine line. The rules for contracting are spelled out clearly in the regs.

Marks wage for oversize to a 1099 driver is not that hot once you figure in the costs. That driver should skim 30% off the top for taxes for being a 1099 driver he will be responsible for his and Marks share plus S.E. tax. Rough calcs put the driver netting around $700 a week after ded.

Just an thought, quality drivers are hard to come by and I firmly believe you get what you pay for. ( Walmart accident rate vs. J.B or SNI accident rate ) An experienced heavy haul rigger will be even tougher to find.

    Good hunting.....

The IRS makes their classification of employee and independent contractor based upon control the company has over the worker or contractor.

The amount of wages paid to a worker doesn't necessarily mean that you get a high quality worker. Just look at some of these union members. Some may work hard, but most of the ones that I see are lazy and inept. You would expect that someone who receives a higher wage would be more competent and work harder, but that isn't always the case.

JB Hunt, Schneider and some of the mega carriers pay benefits and pay their employee's taxes for them, yet I don't see them as being any more competent than someone who works on a 1099 or for a small carrier. Some people prefer a small company to a mega carrier where they are only a truck number.

Just because someone is paid a high wage has little to do with their work ethic. I have known people who are paid minimum wage who take pride in their efforts and do a good job. It is the individual and their work ethic.

I have no doubt that if everyone had to sit down and write a check to the IRS for taxes, there would probably be many who would choose to not pay them. Taxes are way too high. It doesn't have nearly the impact on one's Psyche when it is automatically taken out of your check as when you have to sit down and write a check after you have received your paycheck.

I have never thought it to be fair for anyone to have to pay in taxes in advance of what you "estimate" your taxes that need to be paid. That is another advantage of being incorporated. You can pay as you go if the corporation pays you a salary.

I agree that it will be next to impossible to get either party to change the way in which our failed tax system functions. Both are addicted to having a blank check.

And I will give you that as existing Gman however I personally disagree. As a competent professional I am extremely money motivated and can tailor my skills to the wage package aka "take care of my job" and give only what's necessary.

Point: I am trained and can blend chemicals off the side of the transport using field titration. I would never do this for SNI as he would never pay me for the skills value.

Point: I recently took a job at a common carrier out of convenience while waiting for other plans to gel. The carrier handled many products along my experience lines like cryogenics, oxidizers etc. I played ignorant when offered the loads due to pay issues.

My other plans included buying a truck and that's done. I would pull these same loads for my lease holder as he pays and by the same token I would certainly give someone like Walmart a 150% effort vs say SNI whom I would simply use to bridge between good jobs.

Union guys stand around because they can bud, has nothing to do with ethics. Trucking has taught me to be leary of all deals and to trust no carrier until given reason to do so.

WHO REALLY CARES!!!!!!!!! All the guy asked for was input on WHAT he was looking to pay a driver, not HOW he was paying him. Why is it so hard to keep things on track????
To the OP - I would say that I think you might be a lil on the low side. A guy should be able to clear I would think around 3500 a month in that type of work. Just my .02

This is a key determing factor that the IRS uses.

Thanks for all the relevant input guys. I've decided to listen to those that have gone before me and sell the truck. I'll keep the trailer for a while until I figure out what to do next, or if I can't shake the white line fever. I actually hate and love trucking all at the same time. I know it's a common condition. I think I now like the trucks much more than the trucking.

I really resent what being an owner operator has become due to massive over regulation and the raping of America by the oil companies. I'm all for free markets but when we pay more per mile for fuel than we earn to pay our bills and feed our families then something is very wrong.

I want it to be like it was when I bought my first truck in 1982 - an adventure, a respected and profitable career and a lot of fun! But those days are gone, and so am I - at least for now.

    123456 Thanks this.

I never haul a load that will not cover my cost per mile + .20. I just wont. If I cant get a rate like that then I will deadhead. Not into supporting the cheap freight market. If one looks hard enough there is freight out there ALL OVER THE COUNTRY that is paying well over 2 bucks a mile. I dont know how some people that might call themselves businessmen, cant find it and make a really good living out here... just my .02
