I have been with my current company since 2002. Just last Thursday I tried to fill up but the company card was declined after 15 gallons needless to say I paid the money out of my own pocket just to get out of there, a few hours later the cards were turned back on. The next day I check the bank to see if my paycheck was deposited and no money. When I called the company they stated there were trying to get enough money in the account to pay everyone by Monday or Tuesday...5500 miles with half team load unpaid for. Not only that, We had to pick up a team load Saturday, so thats another 2000 miles by Monday without knowing whats going on....I'm so confused.. What legal action do we have out here?

It's a small company out of Illinois but like I said I've been with them since 2002. I'll give them a chance cause maybe it was a bad accounting error at least until tuesday...but that doesnt mean my tanks ain't full and only 800 miles away from home.

Alert ! Alert ! The same thing happened to me as an O/O. They got ahead of me to the tune of $10 grand, what with paperwork being turned in in person and weekends etc. and me leaving out the day before "payday" with the owner saying "I have your paycheck here in my drawer", I trusted too much. Then a cell phone call 800 miles from the barn saying "We're out of business effective at 2 pm today, but don't worry, You'll get paid". BS, out of $10 grand owed to me, I got $3 grand. Not having $$ for fuel and not getting your paycheck are hugh red flags.

Illinois and Indiana are the two worst states for flim fam operations according to safestat. A company going under is alot like a heart attack. There are warning signs first. In operation 1 month or 20 years, they all can file bankruptcy. The way the economy is and high fuel prices is getting the best of them. If you don't get paid by Tuesday, look at the IL dept of Labor website for help.
