Stay Away from this Owner/Operator

    You have to able to prove what he owes you, and not just walk into court and say so.. some nicely established documents would help. And yes, I'd file suit, but as the lady said, one guy took him to small claims, got a judgement... but there's a HUGE difference in GETTING a judgement and GETTING PAID on a judgement.

    Scumbags like this usually have creditors lined up down the block, so you have to get in line. Breaking his legs is a much more viable option.

    How true, I've had a judgement on a trucking company since 2000, I'm 3rd in line behind the IRS and the state...He's still in business under a different name and I'm still waiting for my check...:biggrin_25510:

    Yessir... I was filing claims and getting judgements when I had a detail business years ago... all it does is muddy up your own company's credit report by listing them all... a quick glance by an untrained eye may mistake other people's judgements for YOURS.. not good.

    You are sneaky and very good! I like it!!! Dan's attorney has been notified but I am sure he will disappear as soon as he's garnished. He will probably put everything in his son's name if he hasn't done it already..We are supposed to go to our appeal date on the 28th. I would sure like to see this guy hurt financially like he hurt us. We could have gotten out of the hole and finally started getting ahead. Now we are worse off than when we started.

    You're right ronin, my husband didn't have the figures written down like he should have so I made sure he did it right this time. On the other hand, the judge I'm guessing didn't know how to decipher the log books so he just went with Paul's spreadsheets and called it good. This time he has his ducks in a row. As for all of the other crap the judge doesn't want to hear it. He doesn't want to hear how hard it's been for us financially etc....

    So let me ask you guys this? Why aren't trucking companies worried about the Labor Board? The last company my husband worked for had at least 30 complaints against them with the Labor Board and it doesn't fase them at all. What's the scoop?

    In a longer conversation, you'd find that I strongly believe that a man's honor and a man's business ethics should be held to same standards as they were in the 1800s, and up to say, 1940-1950...

    I don't have much regard, at all, for the whole lawyer talk and threats of suits, or writing down someone's license plate numbers... you mess my family over, I'll come visit. A man (or woman) is most dangerous when they have nothing to lose.

    I've surprised a few people over the years who thought I would play by the rules while recovering from theft, fraud, or deceit, or just bad business, and I haven't played by the rules.

    I guess where I'm going with this is that THIS is one of those situations.

    Get over yourself :biggrin_25513:, PRISONS are full of mental midgets with that mentality.

    Same as STEALING a partial trailer load of furniture to cover $ owed , thats THEFT plain and simple, you cannot SIEZE a fart in the wind LEGALLY without a court order.

    That's just it, no one was leaving that dock with anything, it was simply a perception. And it worked. Seems all you post is negative stuff, try lightening up a bit and your blood pressure will go down.

    I'm not even going to address the "mental midget" comment... and you've obviously never been hurt beyond the norm in business or in life. Just like the bully at school who won't take reason for a response, doesn't mind the school principal or adhere to the rules... there's just no dealing with him through normal means... and the only way you get the bully to leave you alone is by fighting him.

    I really do envy people who have never had to experience things out of the ordinary, that don't fit into that neat little black and white area we call social norms... good for them.

    Let me ask you this.... if a guy walked up to you in a bar, perhaps thinking you were someone else, and slugged you in the mouth, would you (a) apologize for being in the wrong place at the wrong time, or (b) sue him, or (c) hit him back?

    That's obviously not the normal way for people to act (on his part), so how many people would pursue one of the first two courses of action?

    For the record, not me.

    You have no CLUE of what I have gone through in life

    And for your bar room question (D) Put him in the Hospital but that situation would be a bit different than just owing me $.

    I take it that you had lots of experience being the PLAY GROUND BULLY :biggrin_2559: I on the other hand had the EXPERIENCE of sending them home to MOMMY :biggrin_2553::biggrin_2553:
