Has anything like this ever happened to any other drivers?

    Well it's been quite a while since I've made an update.It's been over a year now.I haven't won yet but I haven't given up the fight.Medical bills wound up being over $40,000.Sometime in the next couple of months we are supposed to have a full fledged trial.I will be so glad to have this over and done with.I feel real bad about not being able to get the Ohio Hospital paid off yet,they were absolutely great to me.The last workers comp hearing we had Allen Fischer had 2 lawyers there fighting me and trying to make me out as a liar.Ohio still saying it's an Indiana claim and Indiana saying it's an Ohio_One bad thing is I have apparently developed arthritis in the vertebrates right at the base on my head/neck doc says it's most likely from damage there caused by the injury,hurts like **** in cold weather.Well nothing else to report,I hope everyone is staying safe.

    They all want the insurance payments and don't want to pay anymore.

    From my understanding, because I went through a similar situation, is an interstate employee has the option of filing a workers comp claim in the state of employment, the state of injury or the state you live in. Since you are a company employee and your company pays it's workers comp insurance, they are the one responsible for filing the claim. Since the claim was filed by your employer first in Indiana, they should be the state responsible.

    I too was denied my claim, and after I contacted the Iowa Workers Compensation Board, they forced them to pay or pay a huge fine. Luckily everything was taken care of and nobody haunted my DAC or anything.

    Spinal injuries are like many other injuries. They can go undetected and get worse with time.

    I don't know if your lawyer done it, but the state of Indiana's Workers Comp Board should of been involved in this case. It was your choice where to file the claim, but it should of been done through your employer. The claim that was filed the earliest should have to pay. There was nothing malicious involved in the way it worked out. What it boils down to is the two states got wind of each other and they are trying to weasel out of it as an excuse.

    I went to get my prescriptions filled yesterday and Walmart told me $260. What?? Yes sir, your insurance has been cancelled. What? I'm at home too from health issues. Work has said nothing of being terminated, nor has the insurance company. I'm suppose to be offered COBRA if I was terminated?? These insurance companies are nothing but legalized crooks. One thing I learned since I started going to doctors is our health care system is really screwed up. I guess I'll be on the phone today.

    I'm sure things will work out for you after they are done pointing fingers. I've never sued anyone. But in a case like yours, I think I would sue the crap out of them just for general principal.

    Be real careful what you say on this public forum. There's a good chance the bad guys are reading it. :)

    You can quit your job and still be able to get cobra. Somethings wrong.

    I looked into getting COBRA.It was $345. a month,I couldn't afford it.

There's a good chance the bad guys are reading it. :icon_smile: Yeah I know, my typing finger got away from me and I don't know how to go back and edit.Unfortunately I don't think I should put the name of the company yet,I don't want to jeopardize my case in any way.

    I just did the same. However, since she hasn't been on here since May, 2012, we'll likely never know the outcome.
