Well, once they made a statement saying "we don't want to play favorities".
Two other times, they said they did not have any work for me even tho they were sending guys out in trucks every day. I don't feel I have the right to tell them what they assign me to but just that I need accommodation in that I cannot remain standing and need a job where I can sit down when 'needed'. They can easilty accommodate me in so many ways each and every day without a hardship on them. They just don't want to.
So, does anyone out there know if it's illegal for them to bring me back to work without a doctors release?
I've been back to work since last October.

If a doctor signed a piece of paper stating you can't work, then the doctor has to sign a piece of paper you can return to work. Alot of time when they excuse you, they will be asked when you will be able to return to work. The doctor might of put a time frame on the initial report. If it's questionable, he'll put he'll re-evluate you in two months or so.
You have a right to your medical records. Send that doctor a letter requesting them. They have no choice to release them to you. But they are allowed to charge up to .25 a copy.
If the company didn't get a release, then no they can't trick you into going back to work. I'm home now on a disability. They will play games with you. I never dealt with so many crooks in my life. Nothing but a bunch of educated weasels.

Ah, 'educated weasels' is a perfect term to describe these people. I and my fellow workers have no experience and are very ignorant and they and their lawyer know this.
I am glad I'm working and back to work. I could not survive on unemployment even tho I would make the maximum allowed and would qualify.
I'm just looking for something to give EEOC as a reason to prove their blatant retaliation against me for asking. I am hoping to get my benefits back. I was sick this past week and had to take a day off work without pay which is going to really hurt me this month.
I don't mean to toot my own horn but I am a very good employee. I never complain unlike a lot of the other guys about jobs assigned me (they moan and groan and ask to have it assigned to someone else - sometimes management does
depending on who they like is asking). I'm on time and rarely take time off and never during critical times. I have a great track record with my other employers, JB Hunt and THE largest asphalt/cement company in the region.
I'm a woman and work with all men. I've been driving for a long time, here 7 years this month, and I'm 58 yo this month. I have never filed a lawsuit until this happened. I have always dealt with harassment myself except where it involved a foreman and that happened here.
This employer has always oppressed it's employees and the men all have very low self-esteem. I'm here because I get home every night, 40 hrs. week, and the job pays my bills but just barely.
