Flatbed - yeah, they filed for protection last week but asked me to not comment on it - it's Lewis' only way to protect the current assets from further seizure so he can continue operating AAX while trying to get "Runway" up and operating (which is what I reported several weeks ago). Haven't heard anymore details about Runway or new trucks yet but should know more by next week.
When I joined, I came on with expectations about pay that was quoted on their website. Then I found out later they do not pay 42cpm but pay 32 cpm. When I initially complained and threatened to make a fuss about fraud, I was told by the then CEO (one of the guys Lewis fired a month later) that their webmaster hadn't edited the website in over a year and that they didn't know how to get in touch with him, LOL!
I see they have updated the site a little, it shows 32cpm, it shows the downtown Atlanta headquarters address, and shows Jamal Lewis as CEO, but it still shows Calhoun as a terminal and they closed that effective 1/1/11. They haven't had a fleet of tractor trailers numbering 500 since last summer (probably about 110 trucks and 140 trailers today).

From what you have experienced , I would STAY far away from them or any NEW outfit they start up , remember a SKUNKS odour follows it where ever it goes.

And anyone can make a website "LOOK" good!
And as stated I'd be way careful of any company coming out of Chapter 11 or any ot those numbers or of the "people" from the old company starting up another one until they have been "proven" to be a stand up company and not a mirror image of what they were before!

Remember, you don't marry the same person you divorced yourself from! There was a reason for leaving do you think they changed how they were? As the saying goes a Leopard can't change it's spots!

I'm not sure but I think the original owner has gotten rid of the "partners" that were screwing everything and everyone over so it's not the "same" people over again or am I reading this thread wrong??? Jamal Lewis(?) I believe started the company but had partners and he was an owner in name only, now he is going to be a part of the team instead of a silent partner....I don't know for sure but that is the impression I have gotten from reading this... if that is correct then it's not the same????

You are correct - my only hesitation, really, is whether or not he (Jamal Lewis) began this process too late and can he get the financial backing to move forward with the new company. I'd feel a lot better about it if they had new trucks as evidence that a bank has trust in Lewis to pull it off. As of Friday I was told they didn't even have an AAX rig available which is hard to understand as I know they must have lost a number of drivers in the past two weeks.

I would not worry about new trucks. New trucks mean more debt and less operating capital. When a company files a chapter 11 they have a plan for repaying their debt. Many companies come out stronger than before the bankruptcy.

Again, people are not reading the full info provided in this thread - AAX is not "coming out of Chapter 11" they just went INTO it.
The new company is NOT run by "the "people" from the old company".
The old company was Jamal as owner and two others as the chief officers and they are the ones that commited the fraud and theft from the company and upon the drivers. Runway is Jamal as owner/President period.
Since I joined in early December they HAVE changed how they were so your critique is moot. Elogs, consolidated fuel network, driver advances, down-sizing, closing a larger terminal and relocating to Florida to be close to their major customers (Coca-Cola and Publix), and a total shake-up of personnel at the ATL headquarters.

Arrow went bankrupt plain and simple and ceased operation. That is example is not comparable to what is going on with AAX.
AAX is seeking legal protection while reorganizing its debts (and dealing with other legal issues surrounding the actions of the former Pres/and VP of the company). As stated, it is my impression the Chapter 11 of AAX is to give the opportunity for the reoganization as the new company, Runway.
In just the last 2 weeks the safer web report on Runway has updated to show them as interstate (they were intra-state) and with one truck/driver (they had shown 86 trucks and 130 drivers which is the number of trucks and drivers for AAX - half solo, half team). Clearly it is moving forward one step at a time.

Still sounds like a house of cards to me. Keep those other options open, driver. This Jamal was the owner when all of the shady stuff happened and with a company of this size it is hard to believe he was out of the loop. Bankruptcy filing and hiding of assests to avoid reposession isn't a good way to start a new company. This is not a sleight on you. Many of us have been burned by giving the wrong person the benefit of the doubt. From what I have read, you are aware of how things run at this outfit and are prepared to move on if needed. Just remember - they are your employer NOT your friend! Good writing. Clear and to the point. Have enjoyed reading your posts. Good Luck.

All I can say is that CHAPTER 11 is not the business award of the year that so many make it out to be.

You seem determined to go with whatever rises out of this CHAPTER 11 so have fun.

Chapter 11 only works if all the CREDITORS agree on the restructuring , just filing for it does not make it happen.

I understand where you're coming from Flatbed, but ya gotta figure a company at least trying to stay afloat is a step or two farther up the ladder than one where the owners fold the tent and skip town. Part of my reluctance to jump ship is that after 15+ years of driving and 3 recent years of looking I have found no other company running solo drivers from the SE to the NW on dedicated freight and I hate to lose that!
    stay tuned.
