This is why you need to always be looking at LEAST 15 seconds ahead of your vehicle. That gives you time to identify and evade hazards that come into your path (ie : A vehicle parked on the shoulder with the occupant(s) outside the vehicle.)
Not knowing all the evidence, a proper judgement cannot be made. My initial observations based on the driver's statement suggests he did not attempt to move over until the last minute which suggests that he was not paying proper attention.
It is nearly impossible to tell if a vehicle on the shoulder is occupied or not. It is always the safest practice to move over and slow down for ANY vehicle parked on the shoulder. You do not know what is going on with that vehicle. The driver may open the door, come from in front of the vehicle, may not have control of his/her kids, etc. With enough eye lead time you have enough time to signal your intent to move over and avoid a possible deadly outcome.
