Sorry your not cut out to be a truck driver...find another line of work. Waiting at docks comes with the job. Throwing a hissy fit on the dock, and driving off the customers property and then whining to your FM. really? Trucking isn't a 9 to 5 job, and things aren't always going to go your way.

I am going back to the old job I left in March after 8 months because I wanted to be home weekly instead of every 2-3 months. It's a heck of a lot better money than Schneider but I was willing to do because I have young family.
The fact still is, it's the law to answer no the question. And about the big company is too big to make a mistake or act unethically, are you serious?
Look around you, read a newspaper once in a while instead of having Rush Limbaugh and his ilk spoon feed you crap.
I had heard a lot of talk about how Schneider cares about you- saving your job while you mourn a grandmother and stuff- and I wanted to tell the other side of how they acted with me, breaking the law. The job i am going back to is very clear that its an at will job, but Schneider has to illegally besmirch my record. That's the way you want to be treated by your employer? You don't think you have a problem when you have to watch video from Don Schneider saying how bad unions are, and he will make sure communication will take care of all problems. It felt like I was in communist China or USSR listening to propaganda, but in this environment you take it. It's pathetic, I'm not optimistic about the American worker. It's like arguing with 14 year olds on youtube. -
I really liked his line later on where he said "I obey the law and Im a bad guy"....really if you obeyed the law yow wouldn't have a criminal record now would you???
I was just reading the newspaper about another cop getting indicted for beating the crap out of a young bicyclist. He didn't get away with this this time because the cop he was training testified against him. Of course in most cases police will stick together as they make up stuff, which is what happened in my case 10 years ago and no matter how little sense their accusations make their charges will stick. It doesnt make me a bad guy because I ran into some clowns, but the rap sticks. I think the Massachusetts law is a right step to take. You are an employee why does it bother you if there is some checks on what big companies can do to you? -

So, if they broke the law as you claim you have filed charges and/or a lawsuit correct? You do realize Don Schneider retired a couple years ago right? and again like the rush thing what does that have to with the topic? Communist China??? Since he wants to put politics in the mix, he sounds like another Democrat looking for a handout. That's why you vote Democrat right? The party of entitlement. God forbid you actually make an honest wage. Let me know how that government cheese taste.

This is a truck drivers forum, I tried to bring up an issue that I hoped other truck drivers would have some interest in. Being a long time reader of these forums the anger and hate directed at me is no surprise. Over the years I have tried to understand why these apologists of the status quo are so dismissive and happy to see somebody run into problems. Thus it gets into their politics. The topic is company wants to get rid of you, they are desperate to burn your DAC report. What the hell is so admirable about them not touching the real reason why they don't want you, and instead break the law.
I don't feel like arguing over the same things.
I have a job that pays better but with less hometime. I could give a rat's ### about Schneider. I care about my DAC report and as soon as I figure it will show up, I will clean it up.
I will also give a half hearted effort to see if Massachusetts agencies give a #### about their law, or if they can do anything about it.
If any news come up I will let you know. Keep up the good work of trashing any undeserving complainers to this forum. -
I don't know where you are getting the anger and hate from, the problems you seem to have with Schneider are were self inflicted. You lied on your application and you left the customer without permission etc. The company, whether its Schneider, Swift, or the ACME trucking company are not to blame you are. Stop blaming everybody else and being a victim.
"Apologists of the status quo"... most of us are not. We are professionals who do our jobs and when we do something wrong accept responsibility and move on without trying to pass the blame. That is part of what being a professional is about.
What is the "real reason" they didn't want you? Race, religion, sexual preference, political affiliation what? You think they are just sitting up in some big office going through drivers names deciding to get rid of this one and that one because of x reason but will keep this one and that one because they "fit" the profile the company is looking for? You implied this now man up tell us what you think the real reason is.
Again if they broke the law as you claim, have you filed charges or a lawsuit? I'm sure there is a lawyer in Mass someplace willing to go after a company with deep pockets if they thought they could win.
I'm still trying to figure out where politics plays into this. Its like whenever somebody can't make a rational point they try to throw politics into it.

Again, I have moved on. The reason they fired me is that as you say I left the dock -they ordered me off the dock- not much space to be hanging around that busy little street with 2 other waiting trucks taking up the whole street. That's how short that street was. That and the reason I whined.
Great, put that as the reason I got fired. Instead they tell me that's how they wanted me to act, they were very adamant that I behaved correctly. I am not the one that says that, I admit I was peeved and I didn't want to take a risk feeling pissed off. I expressed my concern cooled down and went back and did my job. They have their reason of thinking, we don't want this guy crying every time he has difficulties. Of course this was my 1st week out and extremely careful, but I get it. (from the start).
But they insist it's because of my application. Now if you are filling out the application and the question says "have you ever been convicted of anything" but the sentence next to it say "IF MASSACHUSETTS RESIDENT, ANSWER NO IF MISDEMEANOR OLDER THAN FIVE YEARS OLD". What does that tell you to do? If it's on Schneider application you act like it's the law.
I have said it all along I will look into it and let you know what happens, since I have moved on, it's not a priority in my life but i will try to see if anybody is interested. Also that's the point of me writing on this forum, see if anybody knew any more about it.
The DAC report I will wait a month or whatever then ask to see it, if I find that it says I falsified application I will contest/appeal and giving the reason I followed the application directions.
As about anger and hate, more than one poster replied with "eat government cheese now", and "your DAC report shows you lied" with glee that I got what was coming to me.
I make a valid point about a big company, but you concentrate on my faults, you have no interest in what policies companies have and how individual truckers might learn to protect their rights.

As a student I am finding a lot of good info info here in the truckers report forums. If the world of trucking was all sunshine, I wouldn't be here learning what to expect from the industry. Although this is an issue I am seeing a lot here lately (not just specifically the Massachusetts thing), but the "have you ever" statements, and the "I certify this to be true" (not to the best of my knowledge), but absolutely the word of God himself true, and "I don't remember" is not an excuse! Does this mean I am a liar? There are only a handful of people in the world with photographic memories. Is this a requirement of all truck drivers? Not just trucking... I see this more and more everywhere... I mean come on, give me 10 minutes and I can ask you a question about something you can't remember. Does this make you a liar? I don't think so, and I bet you wouldn't thinks so either. Knowing this I am not filling out any applications until I have an N.C.I.C. background check (that I pay for $150 plus driving 60 miles to be fingerprinted) and an A.C.I.C. background check from my state. (the feds and the state can sometimes have different info on you) there goes another $50 bucks, plus a T.S.A. background check to get my hazmat, with my CDL costs there went another $183. Even now I am being told and I quote both the federal and the state officials who are "helping" me to get this info...(all in the name of not "falsifying" a CMV application) "This is not the same information an employer or insurance company can obtain from us" What?!?!? (of course this is after the credit card payment cleared, not before) You add the DAC (which has very little accountability, and should be illegal) to the mix and you have a potential for disaster. Don't get me wrong, I am not taking a side in this thread, I am pointing out a common situation that IMHO has a major flaw in it. I think in this situation it is much more "professional" to say "hey, we found something in your criminal history that may be an issue, providing the offense does not make you unemployable, Do you submit to a polygraph test?" "Ok, the first question is... Did you knowingly fail to mention this misdemeanor on your application?" --- At least you would have a chance at that point to be "human". We make mistakes, we are human. Should we be forever ###### for life over a misdemeanor? I once many many years ago... (sorry Corporate America, I don't remember the exact date, or offense description, or the court disposition, or the amount of restitution paid to the cent, only the lesson it taught me.) I got a ticket for a speed in excess of 100mph. I was a stupid kid with a fast car. (how many of you out there have been one of those?) I know that was at least 20 years ago or more. Does that make me unemployable, or is it the fact I can't remember exactly when? I'm thinking that most truck drivers are far from goody-two-shoe-little-miss/mister-perfect-I'm-all-that-and-a-bag-of-chips employees that dropped out of seminary school to be a truck driver. Come on Big Truck Company, I'm not trying to lie to you, I will tell you anything you need to know, I have nothing to hide. I just wanna work!!! Better than saying "Aw to hell with it, I'll just get on welfare, and make everyone else pay my bills." Don't ya think? With a little luck and some sweat maybe I can make us both some good $$$.

Just an update. I checked with attorney generals office and they sent me to MCAD- commission against discrimination. I told the story and she said they only have jurisdiction under this law if a company doesn't hire you because of the old misdemeanors. If they fire you then you need to pursue it with a private attorney.
What a joke, I don't care about it that much.
The DAC report I care about, but it will be a while before I'm home to receive it and then appeal it.
