So back to my question, should we change to off duty and log out with proper notation? Or is that bad. I'm waiting to hear back from Peoplenet as well.

Correct, however there is a problem with EOBRs if they are not programmed to accept that option.

There's no guidance that I've seen that your location should change when driving while off-duty. For example (using my hometown)... you unload and go off-duty in Freeport, TX, then drive off-duty to Walmart in Lake Jackson, do your shoipping, and return to Freeport, or even drive to Houston. Seems that the only log remarks, flags, entries, etc, would be where you went off-duty, and where it was (and when) that you came back on duty.

Here is a scenario for you. Lets say I got loaded on friday morning, drove 600 miles to the receiver, but they wouldnt receive until monday. So I stop (loaded) at a nearby truckstop and sit there for the weekend. There is enough time there to get a 34 hour restart. Am I allowed to use line 5 to drive to a mall or walmart? This is personal conveyance for personal use as far as i am concerned. Nobody (not even me) sleeps 34 hours straight.

If you drop the trailer and use your bobtail for personal conveyence - you have to be without a load while traveling, because otherwise, you're transporting cargo.

    Meltom and lostNfound Thank this.

What if your company would rather you not drop it for security reasons? As far as I am concerned, OFF DUTY is OFF DUTY. That truck is not a jail cell.

Do what you want. The rules are meaningless anyway. I give up!

I think I need to take a break from the forum for awhile.

Your company would probably have a policy stating how you handle this. I know my former company did not allow personal use, or trailers to be left unsecured.

I should not have to break up a 34 hour restart while I am loaded just so I can go down the street to go shopping during a break. Moving a truck is moving a truck. This was never a problem with paper logs. But now you have to account for every second with e-logs. I got a big taste of this BS at Butler Transport, and I would prefer to not have to call in every day to update this crap.

Unfortunately you're going to have to call a cab. A company driver is going to have to abide by their company's policies (assuming they are stricter than the FMCSA regs.). An O/O typically has greater leeway in the same scenario. The use of both a pin lock and gladhand lock as well as being parked in an appropriate place will go a long way to relieving any concerns.
