CSA 2010 & Arizona DPS

AZ has a couple of differences in truck specs that go above and beyond... like their no-sail mudflap requirement. I'd be checking AZ law instead of Federal guidelines.

 

Works for me, just hitting the bare minimums. Looks like reflective tape is required on mudflaps to me. I don't see a distinction for with or without a trailer.

A couple of points I could be wrong on that I'm just too lazy to look up right at this moment, so if you know different then by all means, correct me.

1. Mudflaps are not required on the truck when connected to a trailer. I have been inspected when there was a mudflap missing on my truck due to it being ripped off, and I did not receive a violation as I had a trailer at that time.

Now, that doesn't negate the requirement for reflectors or retro-reflective tape (which can be located on the rear crossmember or similar), but it does make it hard to enforce a regulation for reflective tape on the mudflaps or hangers themselves if they are not required to be there.

2. In general, for trucks that are regulated for the purpose of interstate commerce, states cannot enact stricter legislation than what is required federally (or they can lose federal funding). Now, I expect that statement is going to get some holes poked in it (hopefully with supporting proof ), but my understanding is that a truck that is legal insofar as the federal regulations for safety, conspicuity, etc., has to be accepted by all states for interstate commerce usage.

 

This law can actually be challenged and beat under the fifth amendment. If you are required to have a permit before entering the state but they force you to enter the state before getting the permit that is self incrimination.

This is how the marijuana stamp act was defeated in the 70s. The stamp act stated that you could only posess marijuana if you got a stamp from the government. The catch was you had to be in posession of the marijuana in order to apply for the stamp. The supreme court repealed the law on the grounds that it forces an individual to incriminate themselves.

 

Meltom, how about a comment on Arizona mudflap law 28-958,01 section C par 2

 

Sorry was in meetings the rest of the day. Looks legit to me, the only thing I would argue is that this will allow you to not have mudflaps, but it doesn't allow you to have mudflaps without conspicuity tape.

I would say you are right; they're not required, but if you have them they have to have the reflective tape.

 

according to Arizona law, you don't need either mudflaps or reflective anything when your hooked to a trailer.

 

don't need tail lights on the tractor either when hooked to a trailer
