    Go for it. The worst that will happen is that your claim will be denied. I expect it will, but it will only cost you a few minutes of time to file. You can do that online. In fact I think you are required to, at least in my county.

    The reason I asked the questions I did was because I was thinking along the same lines as Baz and SlotCar in their posts above.

    Baz is right; in order to qualify for FMLA (Family and Medical Leave Act), you must have been at TMC for 12 months. So that's out. I didn't realize you'd not been there that long.

    As SlotCar said, I think you should contact your unit. ARNG "might" be responsible for paying you until you are fit for full duty, or at least protecting your off-duty job until you are released to return to work.

    It just does not sit well with me that you should lose your job because of an injury you received while serving our country, and this looks bad on TMC. BTW, I thank you for that service.

    Having said all that, perhaps we should get back to your original question about termination on your DAC. "Termination" means only that your employment ended, not that it ended badly. Maybe you could just call up your FM and tell him you are concerned about this, and ask him exactly what is going to be put on your DAC. You should also ask if you are "eligible for rehire". If he tells you that you're not eligible for rehire, that will mean you should not count on them as positive reference.

    I thank you all for your comments and concern for my particular cercumstances. I also thank you for your care regarding my time with the ARNG in this, at times a pain in the arse, Country of ours. I serve proudly, going on 8 years, and will continue to do so as long as this Country will allow me to do such.

    I have talked with a friend and the two of us have come to the conclusion that TMC terminated my employment because 1) they could and 2) to stop paying for WC for having me on their books. I am still going to talk to my Unit concerning my termination. I am also going to talk with my FM at TMC and see what kind of "termination" will be on my DAC. I was told by my FM that I can just call when I am back to 100% and they will Hire me back. That is great but, now I will have to get another Med card and take a physical..LOL Oh well, things are far worse for others than me...

    If it does go south with TMC, you may want to contact the Employer Support for the Guard and Reserve (ESGR) representative for your state. Thats what they are there for.

    I apologize for not updating sooner but here it goes...
    It took 1 month to get my follow up appointment and that Dr said I need Physical Therapy, 12 visits.. It took about 2.5 weeks to get the authorization to attend my Physical Therapy. I have completed 3 of the 12 visits needed. Now, as far as pay goes,,,thank you Mom (Mother in-law)! She has kept us afloat and we are thankful to her for that.. I FINALLY received the paperwork to fill out for my InCap pay (Workmans comp type pay for military). I filled it all out within a day and sent it back than had to forward to TMC so they could fill out there part. I than had to wait for the 4th to get over and received my filled out paperwork from TMC two days ago and I forwarded it to my Military rep. Now the waiting game,,,again! My rep told me that headquarters was holding a "Board" this week so, hopefully I can get me some money sooner than a month..

    I have completed my 12 and final Physical Therapy visit last thursday....
    I still have not received any money from the state..thanks again mom for helping us stay afloat.

    Another update;
    I just found out that USX will not be hiring me due to being terminated from TMC. The say that because I did not have 6 months of drive time with TMC and got terminated than I do not qualify for hire...LOL I laugh, it does not matter what the reason was for me getting terminated but I know now why they take this posistion.

    A few days ago, I got a call from my Guard Rep who told me he needed some MORE paperwork to get my INCap going...LMAO Go figure! Anyway, one of those documents he wanted was a memo from TMC stating why they terminated me.. I called and TMC told me they do NOT give out any information except the Hire date and Termination date. Well, that means your word is all you got when explaining the reason behind your termination and we know that us Professional Drivers cant tell the truth, so they have to make a policy that protects them...LOL

    Ok, now as far as the Army deal... I have completed my 12 PT visits and have an appointment on the 24th for a follow up. I have sent in all required paperwork to get my InCap started and am waiting........

    I pray that TMC will hire me back, now I am kind of worried about this termination on my record.

    Well, I called Covenant to see if they would hire me... just trying to find a company to start with so I can get my wife on the road but man their pay is outrageous to me. 29.5cpm for solo and 18cpm for team.... I guess I will just have to keep looking and go back with TMC for now... I just cannot believe a team, any team would run for that kind of pay.
