I'm kinda confused about the second test thing myself. You said they asked you to take a second test but you did not. But you say you "did not refuse"

As far as getting another job, with that on your record it's gonna be a lot harder and you will have to pound the pavement more than your average job shopper

What's done is done DarkKnight. Your DAC is ruined. Your only hope is after 10 years you can work for a company that doesn't use DAC and you can honestly not disclose the company in your work history. You said it was two years ago, evidently you have a different job. If not I would seek a new career.

basically,i was really trying to get a lead on any companies that may still hire with a failed test, not refusal(even though both are bad)so if any one can point me in any direction,it would be greatly appreciated?

Your best bet is to go through the yellow pages and comb websites for leads. I can appreciate your need to justify what you did. It makes it more palatable in your own world. The justifications fall on deaf ears here. It's not my place to judge what happened, I wasn't there.. but reversals and contradictions in statements catch my attention.

You may find a smaller outfit that does not subscribe to USIS. Good luck to you.

Then go online to DAC/HireRight's website and print out the dispute form for erroneous information on your employment history and fax it back to them. If Swift can't prove you failed the test, then the information might be corrected to read the accurate information, though I highly doubt it after all this time not disputing it, but you could get lucky if you say your prayers right.

Darknight, it's not like you would have had to pay for the retest, so what was the problem? It would have been just a matter of getting to a terminal to pee in a cup. No disrespect intended, but it makes you look like you have something to hide by not just acquiescing to their request. It's no more inconvenient for you than any other driver. Every single random my husband ever had came back clean, and there was a time he had many randoms done in a short period of time at Swift and they all came back clean, and I do know why they did so many on him and it had nothing to do with a suspicion of drug/alcohol use. Some randoms are not so random, but they do look good on paper.

If your test was inconclusive, it was your job to protect your reputation as a professional driver and do the retest. It was the company's job to ensure that you were clean. They have to look out for their interests and if there was any doubt about your test being clean you become a liability for them, and I don't fault them for that at all.

There are small outfits out there that might hire you, but it might not be one that you would want to work for is all.

I guess I just don't understand why you didn't take the second test. They ask for piddle.......I piddle in the cup. It's not like they ask for a leg.

I hope you can get things to work out for yourself.

Taking OTC medications while logged under line 3 or 4 is just as bad as alcohol; in most cases. Especially OTC medications that make you drowsy. If you ever read the asterisk on the bottom of the bottle, it will notate whether or not you should be operating heavy machinery. If the DOT were to inspect you, you would get a Level 10 CSA violation.

Swift is trying to stay in compliance with CSA2010. As earlier said; Swift didn't screw you, you screwed yourself. Especially when you refused a drug test.
