Hell, I would have been dead and buried, for every car driver I have seen throw a lit smoke out the window right in front of my [1203] placarded rigs. -
I think the cab would be within the 25 feet. In the reg's it doesn't say except in your cab.And YES you can get a ticket for it.

§ 397.13Smoking.
No person may smoke or carry a lighted cigarette, cigar, or pipe on or within 25 feet of'
(a) A motor vehicle which contains Class 1 materials, Class 5 materials, or flammable materials classified as Division 2.1, Class 3, Divisions 4.1 and 4.2; or
(b) An empty tank motor vehicle which has been used to transport Class 3, flammable materials, or Division 2.1 flammable gases, which when so used, was required to be marked or placarded in accordance with the rules in §177.823 of this title.Last edited: Jun 12, 2011

But now that you mention it, this is one theory of how a gasoline tanker exploded in my area about 5-10 yrs ago. -
What gets me is the idiots who cant put the smoke out in the car/cab and throw it out the window instead.
Thats a $300 dollar fine in CA becuase thats how most median and side road grass fires start. What an empty cup with some sand or gravel and you have your self a cigarette ash container.
OH yeah, if the grass fire starts and you get caught, you get to pay for everything, including helicopter air support. Man is that gonna hurt some ones pocket book !! Choppers=BIG money/fines. -
I have never seen or loaded such a place in my life. That will get you canned in most places. -
If we are talking about dry freight, then you can be assured there is ZERO risk to smoking in the cab. Just because there are placards on the load does not mean it is inherently dangerous. 99.9% of those placards are there for the accidents and unplanned release of the contents.

Forget the truck running, even having the lights on or a cell phone on will almost certainly mean a dismissal or banning from the property when we are talking about loading racks for fuel trucks.
If I am unloading at a gas station and I see somebody coming up with a cigarette I will stop pumping and ask them to walk further away from the truck.
