It took eight years for them to get this guy, he now sits in a Federal pen.
So yes this type of thing still goes on in this country. Like I said in an earlier post, always be careful when dealing with a Sheriff or his deputies.

That is correct. When it comes to internal affairs, trust me here when I say that the officer is guilty until proven innocent. If this guy did something outside of policy he will be raked over the coals. At the very least, he WILL be called in to explain his actions. It all goes dowhill from there. We live in a different world now. Don't fear the police, it's the media, lawyers, and politicians who you should fear most, they are the worst predators of them all. It's all about perception. Bottom line, no filler here.

My daughter and son in law are both LEO. They read the post separately and both without hesitation said to get in touch with the ACLU. There is no charge to you, but the situation will be made right.

Well. The bruises are largely faded, joint pain receding back to normal and that funny tingling sensation each time I turn my left wrist a certain way reduced to a tolerable level. The movie still replays in my mind, but not with the same intensity. I will heal from this. I doubt I will ever have the same level of trust in law enforcement, but neither am I paranoid enough to look over my shoulder when I go past LEOs.

I have taken much of the advice and words here to heart. Each of you added constructively to this conversation. Even those who doubt the truth of the story. I do have more evidence than simple he said-she said and photos of injuries. At the time of the original post, I did not think it was prudent to include that little bit about turning on my digital voice recorder when I reached for my flashlight. It's a little habit I developed not long after I started driving...as a sort of protection in case anything ever did happen to me. There would be a recording of my assailant's voice. I assure you, after reviewing this recording several times, my description of the event is accurate.

Now....here is where I will probably disappoint some of you. That recording is not admissible in California court. I did not notify that deputy that I was recording him and I did not have his permission. Neither did I have a court order to make it. It appears my only recourse is to go through the ACLU. This is extremely distasteful for me on ideological grounds.

After considering everyone's counsel here, and that of my extended family, I am not going to pursue this through the courts. I will not place my extended family under that kind of scrutiny. Some of you may understand this. Many of you won't. I am not going to explain myself here. Suffice it to say my family is far more important to me than any revenge that may be gained through our legal system.

I have the full support of my family in this decision. I would beg yours as well.

I felt y'all deserved to know.

Well, I can grit my teeth a bit and respect that decision. One more bit of advice, though. Look into setting up a full multi camera DVIR system on your truck. One that can be locked down so that nobody but you can erase anything off of it.

If this guy or one like him happens across you again, not only will they be on video, you will be able to stop them in their tracks before they do anything to you by pointing out the cameras. Or just put small stickers in your windows warning of the video security system. There's not a thing they can say about it either. It's part of the truck's safety equipment, in case you get into an accident or something.

A sign on the door of your truck stating that anybody who approaches the truck may be recorded by video or sound recording device or both. This may resolve your court issue moving forward.

Injun, only you can make the decidions that will affect your life. Having the support of your family is much more important than what anyone here can say.

Though, I do agree with Kaji. Having a video system is a sound idea.

Just out of curiosity I'm assuming LEO is short for Law enforcement officer ? Anyways i hope you do get some closure to this horrible incident.

It matters only that you are comfortable with your decision. My respect for you does not waver at all in light of your moving on. Like you said, the bruises will fade, but the lessons learned will make you stronger in the long run. Stay in touch!

Just playing the devils advocate here...I respect your decision and the reasons behind it.

This shady law officer has learned that there are no consequences for his actions. Like a rapist that goes free because his victim refuses to speak up or press charges. I'm hoping that what little stink that was raised got back to him and maybe he will think twice before trying this shenanigan on someone else.

Not trying to be a D-bag, just raising a point. But no one here can make the decision for you. It is yours and yours alone. We can give all the advice we want but we aren't the ones that have to deal with the consequences.

    Take care and be safe.
